A bit of advice (maybe legal)

Hi, I have purchased a horse which I tried and all seemed ok so went ahead and bought her, however today she showed her true colours, she reared and bronked today and, although Im no novice, after two sessions of this I got off. I've had her only 10 days.

some of her ad:
' mare with the sweetest laid back temperament.'
'Working beautifully on the flat, and totally bold honest jumper,'
'Uncomplicated easy ride '
'a pleasure to do in all respects'
'100% box, shoe, clip, hack etc'
'Would excel any job'


I have spoken to the lady that showed her to me (the rider) and she is being very helpfull and has promised that she will talk to the previous gentleman owner to see what they can do. Hopefully they will be able to exchange her for something suitable, but I'm worried about where I stand if not. I have every confidence that the lady I dealt with will try to do everything she can to help me but of course I did not meet the owner, so have no idea where he will stand on the issue.

Can anyone advise me on where I would stand if he doesn't have anything suitable, can I ask him to take her back and refund the money or do I have to wait for them to source me a horse?

Did you buy from a dealer or from a private individual? If from a dealer you will have some buyer protection and an exchange could be offered but from a private individual this does not apply - 'buyer beware'.

Hopefully, if a private sale, if you are on good terms with the seller perhaps they will take the horse back and give you your money back but they are not legally obliged, unless they have misled you drastically when telling you about the horse and in that case perhaps you could go through a small claims court.
 
is the lady you bought the horse off classed as a dealer? if so you have a lot more backing in law than if the horse was bought privately.

yes you should be able to get your money back - if she is a dealer.

unless the horse was on "selling livery"..... then I think you find it's a very complicated situation.... I think that would then be classed as a private sale.
 
TBH I think that the lady I bought her from is very genuine so hopefully it won't be an issue. She takes a few from this gentleman to sell on so I'm not sure about their arrangement.

I think I'm just in a bit of a panic after todays event!! I'm sure it'll all be fine.

Feeling really lucky not to be in A&E!!
