I'm not surprised at all!
Sadly in the British Justice System its true they always rule for the claimant with conflicting evidence...we've had experience of this before - I'd encourage your friend to appeal as the more publicity around this the sooner something will be done about it!
 
Caveat emptor? More like caveat vendor! Unbelievable that a judge can find in favour of someone who is simply an incompetent rider and not capable of riding alone - not your friend's fault. Your poor friend, I feel so sorry for her.
 
I can't believe that this has happened. I bought a horse which was supposed to be suitable for a novice but which has bucked me and two other riders off so far because he is so tense and nervy. I consulted a lawyer specialising in equine law and was told that caveat emptor did indeed apply and any court case could take up to two years to be heard. I decided that two years of livery bills and an unrideable horse was not worth the risk, especially since I had been told that I had very little chance of winning the case. If I knew that the judge in your poor friend's case was guaranteed to preside I would file a claim right now!
