ACCIDENT WHILST TRAVELLING WITH A LICENSED TRANSPORTER help pls!

The transporter told us that if we wanted to we could get an independent quote for the repairs, so that's why I sent someone. He immediately said that the lorry was not fit to be used. We haven't made a claim yet, we are trying to prove that the lorry was not safe for use.

I don't think you should be doing that. I think you should be handing the whole thing over to your insurer, telling them that it isn't safe for use in the opinion of an independent expert, and then leaving everything to them. Maybe others will correct me, but I think you need this reported to your insurance company asap and you should stop engaging with the transporter.
 
Please heed this advice, do not engage in conversation with the transporter. It will not do you any good at all. Please report it to your insurance company and let their legal dpet deal with it , I haven't read the whole thread but I am willing to bet that your transporter was not properly insured otherwise he would not be trying to pass the cost on to you.
 
Since last night I haven't had any communication with the transporter. I sent the guy last night as she said we were within our rights to get our own quote. He only confirmed our fears that the lorry wasn't safe. I have contacted a solicitor now and will deal through him for now.

ABB1 - I beg you to contact Trading Standards, they are the only people who can stop this trader and protect any other horses or owners. You are in a powerful position to protect other people.
 
Do you not have any insurance? Are you going to speak to Trading Standards?
I think people are really trying to help you here, it might be nice if you responded to their suggestions. Just a thought.
 
Abbi, as others have said please look into the payload of the lorry. It is very likely she was breaking the law trying to transport 2 horses in a 3.5 tonnes (unless they were small ponies). Make sure you investigate this avenue.

This. I would suspect that a visit from them, in conjunction with a statement from the independent assessor would put paid to any thoughts by her of claiming from you. She sounds like a cheeky wotsit. Second the solicitor and BHS. THEY should be handling solicitors (if needed), not you.

By the way, did she offer detail of her own insurance, as is the norm for such accidents? I'd be very suspicious if not.
 
As the others have said you should not need a solicitor yourself the BHS insurer should deal with everything relating to the claim by the transporter for you .
You might need to have some advise if you are to sue the the transporter for your costs and damages ( which I certainly would seriously consider if I where you) the BHS legal helpline might be the cheapest way to get some advice on that side.
Just hand it all over to the BHS insurer and report it to Trading standards , you all could have been killed you really must do the trading standards thing.

I have actually replied several times, plus I have contacted a few people via private message to thank them for their help, advice and support. It's become a very complicated, and we are dealing with people that aren't very nice. It's under investigation right now and we are still seeking legal advice from several sources. On top of this I have had to work. I've not slept properly for days, and comments like yours aren't very helpful.
 
We are now in the process of a full investigation. Our case has gone to the transport investigators, and we have logged the incident with the police as we were threatened as well. I havent heard anything from the transporter in question. Our insurers have also all been notified. We will contact trading standards over the next few days.

Thank you again to everyone for your advice and kind words. We are just so lucky that our horses are still with us, and no one else was injured.

I am sorry you are having such a terrible time but you will get through this I am glad it's in the hands of all the right people now chin up you will get to the other side .

Thank you Goldenstar, it's people like you that make these forums worthwhile. We've been to hell and back, but I just focus on the fact that we were so very lucky and our horses are both fine.
