Advice needed!

Hi,am really looking for some advice with regards liability and vets bills!!!!
My horse is kept at livery,all the horses have individual turnout and the fields are separated by electric tape and wire.3 days ago I spoke to the owner expressing my concerns that my horse,who has only been there 3 weeks,was likely to go thru the fencing as he got stressed when the others got caught in,his response was to shrug his shoulders.
Today I go up to find that my horse has indeed gone thru the fence and kicked the mare next door,causing damage to the front of her hock

...is the livery owner liable in any way?
Would be grateful for any advice!!
 
There is a saying "you fence against your own". It is up to you to ensure that the fencing is suitable... that could mean string or 10 foot high armco, or anything inbetween depending upon what you are fencing against.

You are liable for any damage your horse does to property or persons. This does not usualy extend to other horses... because horses are noted for injuring each other in the normal course of things. This is why we take out Third Party insurance as a bare minimum.

If your horse destroyed the fence, and caused the owner an expense as a consequence, he could make a claim against you.
 
Presumably you weren't concerned about the set up when you moved there 3 weeks ago?

I can't see what has changed - other than obviously the fencing isn't adequate.
