Advice needed!

I bought a horse from a dealer that was supposed to be a confidence giver to help me regain my confidence.When I tried him I jumped him, hacked him and rode him in the school, he behaved perfectly and jumped well considering i am a novice jumper. After he arrived i gave him a few days to settle in. When i rode him in the school he was spooky riding around the fences, i gave him the benefit of the doubt that it was new surroundings. However he was also spooky hacking out. I had a jumping lesson on him with my trainer. He stopped at the first fence (tiny cross pole). I gave him a slap and got him jumping round on both reins. We then put up a tiny upright, we came to it on a nice rythm, he was keen to the fence but right at the last minute dropped his shoulder and stopped, chucking me off causing me to badly break my arm.
I have tried to chuck the horse back at the dealer as i dont believe it is what it was sold to me as. I dont believe a confidence giver would stop at a 1ft upright, it should walk over it. The dealer will exchange but not refund - does anyone know where i stand?
 
All horses change in character when they move and change owners/handlers.
I allow 2 years to get completely used to a new horse.
If you feel that you have been mis-sold a horse you will need to demonstrate this i.e a copy of the original advert, a witness who heard precisely what the dealer and you said. Did you have the horse vetted and blood tested?

Thing is horses are not cars, they are living creatures that can react badly to a move to a new place and lots of new people. So he may be a very nice horse unsettled by a new environment. It's not always easy to tell. However a horse sold as a confidence giver probably shouldn't chuck you over a jump.

I would be interested to know what your trainer said?

I had a friend fall badly off my really honest mare. My friend kicked my mare and my mare exploded. I would never have dreamt she would bronc like that, but then I never kicked her. As someone said horses take time to settle in. you may have been more nervous on the day you fell and your horse stopped and your horse picked up on that - maybe your horse was still setting in.
