Advice needed

Ok feel for you here OP,
What was written on the receipt for the pony? Is there any mention of having the pony back?
The pony didn't fail vetting but the scabs were noted?
The original vet who vetted is unlikely to talk to you as it wasn't your money that paid for the vetting- but no harm in asking!

They really don't have a leg to stand on here, you say they tried on 3 occasions and vetted her. You could call your own vet and ask how they would have treated the legs, frontline is an often starting point for mites etc!

Out of interest with the "you left the legs on" argument, I presume (please correct if wrong) that this is full feather cob? Long mane? If so she was shown as natural- not an argument/ way of hiding legs!

As horrid as this is OP there really is nothing that you can do here but stand your ground. If they want to take it further they can, you have the whole BHS legal team behind you!

Yes she was a full feathered traditional cob hense why I left we feathers on
But at the vetting the vet asked if we could remove the feathers for them and we did and still had no problems with her it took them 2 weeks after vetting to oranise collection as we had to wait for blood test results that all came back fine and off she went
I offered then any help they needed and said any problems please call me so when I turned up at the yard after tey called me I said look why didn't you call me when she started playing up and they said no she only started yesterday and now they have back tracked and said it started day one
The sales reciet that they signed says
Sold as seen after trail and full vetting

Me too, they sound like dreadful people..if they can't even cope with this imagine what will happen to the poor pony if a real problem arises.

If there is any way you can take this pony back I would seriously consider it. I can't see them giving up easily which is going to be a horrible situation for you, and it alreadys sounds horrible for the pony.
 
Sit on the phone to the BHS, keep calling till you get an answer.

You have offered help which has been ignored.

Be strong and this will get resolved
 
I know I know and I would love to have her back and I am tryin but would mean getting a bank loan out just before Christmas and there's no stable free at our yard any more but my friends riding school have offered to have her short term but it's still the money thing that's a problem do you think I could offer to try sell her for them
 
I sold a horse about 7 years ago
I do work with horses but as a groom I don't produce horses
But they said cause I sold her in the cause if business to make a profit I'm a dealer
Was as a one off geez will never do it again lol


Basically you have to have sold three horses in a year to be classified as a dealer. As others have said, the pony was vetted, the legs were noted at the time and accepted by the new owner. Whether or not they're picking off the scabs is affecting the behaviour of the pony and whether or not the pony will suffer with this issue for life is of no consequence, they have no case to send the horse back.

I would simply write a letter sent by recorded delivery, stating that since the pony was vetted and the issue disclosed at the time of sale and since they purchased the pony knowing and accepting its condition, you are not obliged to take the horse back and neither will you be doing so.
 
I had never heard of rubbing garlic into to sores before but the yard there at the owner insists on it
I said I think may be its the treatment that is making her sore but they assure me it's not !

to me that sounds torture no wonder she in pain. My friends horse got mud-fever for first time ever and it hurts him just putting cream on it dread to think what he do if garlic was rubbed into it (probably wouldn't be able to walk for a while lol)

Just a little update for you all
The BHS have got back to me and have said same as you guys really I am not a dealer an it was a private sale
They had the horse vetted and tried her there for I am not to blame so have to write a letter to them explaining that and have it sent by recorded delivery
I am going to offer to help them In any way and Suggest that they don't rub garlic into wounds and may be just leave the legs alone and treat them how I was treating them as she didn't mind that at all also
To be honest I've gone from being really up set to just angery the way they tried to bully me and when I went up the yard had 6 people there ready to shout at me to take the horse back rather than ask for my help bare oin mind I offered my help several times and even put that in writing to them when I sold the horse but instead of asking for my help they had chosen to threaten me with legal action
I have thought about getting the pony back but feel then I would be admitting it's my fault and a bank loan this time of year is the last thing I want

I have spoken to there vet who is treating the pony and he said they are doin it all wrong so he said he will pop down there and speak to them direct as he feels the yard manager is possibly going about things wrong he said they couldn't use front line directly into the sores and also that he gave them a soothing cream to put on not garlic hahaha he said that is why she is reacting he also said that she wasn't at all naughty for him to treat her and said she's a lovely pony
I have got legal advice from the BHS and am in the process of writing them a letter although I'm not very good at that kinda thing lol

Bloody hell, I'm not surprised she is reacting when people touch her legs if they are applying frontline onto broken skin and rubbing garlic in as well (that sounds like something out of the dark ages). Can you imagine standing perfectly still whilst someone rubbed garlic into your cuts?! If they stopped to think for a moment (although it sounds like they don't have the facilities for thinking), they would realise that this is NOT A GOOD IDEA.

I'm sorry that you thought you'd found your pony a nice home, only to find otherwise :( They sound like idiots who are taking you for a ride. you have done nothing wrong, and by the sounds of it, your pony has done nothing wrong either.

I hope you get this situation sorted- stay strong :)

Well they definitely not got a case. At least the vet hopefully will talk some sense into them. Some people don't have comment sense.
