i recently sold a secondhand saddle after advertising it on a social media site
all information i listed was as i believed to be correct as it was a saddle that had been bought for my horse by his loaner but now surplus to requirements
the person came to view the saddle and asked me several times if the size was correct as it looked small i told them that to the best of my knowledge it was as i doubted very much that anything smaller i wouldnt be able to ride in due to my hieght
i said if there was a question they were more than welcome to try it on my horse so they could see if they could actually fit in it as we all know length is for the rider width is for the horse
they agreed that was what they wanted to do and i tacked up my horse with the saddle and they tried it saying that they felt that there was adequate room and it was acceptable
so they asked me for a reduction in the price as i hadnt realised there was a mark on it and they paid me cash for the agreed price and left with the saddle
a couple of hours later i start getting texts and calls saying that it wasnt as advertised and smaller so they wanted to return it as it didnt fit their horse
i said that i hadnt offered returns and the saddle was not theirs
well to cut a long story short they became abusive and threatening and saying they were going to take me to court
i cant see that they have a leg to stand on as they actually tried the saddle and said it was fine and they paid cash and left with not reciept
i have spoken to citizen advice centre and they have said that from information i provided they havent got a case but i thought i would ask what anyone else thought
 
When you say size do you mean from the stud to centre of he cantle? If so it would have been easy enough for them to have measured it when they came to see it. For your info though length of saddle is also determined by the horse's back. I have a 16.2 who can only take a 17" saddle and I an 5'8". Another of my horse can take an 18" saddle.
 
i appreciate your response they are saying it was too small for their horse because it apparently isnt the size we listed it as but as we now dont have the saddle we cant check that and was advertised as what we had been informed it was by the loaner who bought it
so the fact that they actually tried it on and said that it was an acceptable size for them it would have been the width if anything that may have given and issue but as it is a fully adjustable saddle then that is an easy fix
can i just ask a horse can take a saddle upto say 18 inch but that doesnt mean that it has to have that size it can have smaller just cant cope with larger due to the length of its back yes ?
 
had they been polite i may have but the first contact post purchase was offensive and rude calling us fraudsters and liar bitches
 
I really don't know why people treat private sellers like a shop, it has happened to me on ebay and on preloved whereby people buy an item and then because it doesn't fit want a refund and to return the item!! You pay your money you take a chance, you are not a shop OP so as another poster has put "tell them to jog on"!
 
sound like idiots! if they don't want it then they should just re-sell it, they might even get more for it! happened to me when I bought a pony saddle for my niece to use on my old girl, which we never got round to using.
 
Sold as seen and now they're just angry it doesn't fit and they can't be bothered selling it on. When you buy a saddle without it being fit to your horse you take a chance! She had plenty of chance to see it and try it so she can trot on. Let her take you to court cause she won't win!

For future reference though, always give a receipt that clearly states sold as seen.

A while back my OH sold some tyres he'd bought as part-worn but never used on his off-road vehicle. He advertised them on a forum stating exactly that. These tyres new cost over £150 each, he was selling all 5 for £100 just to get rid of them as he no longer had the vehicle. Someone from quite a long way away came to buy them as he was visiting a friend in our area. He spent an hour with us drinking tea and checking the tyres etc and off he went.

A few days later OH had a text from him saying one of the tyres had a puncture and another two had insufficient tread on them to be legal. Bearing in mind these are off road tyres this would be impossible, plus OH is a traffic cop so knows tyre tread depth laws inside out and would never pass on dodgy tyres as he's seen too many accidents caused by them.

Even if this was true, this guy wanted all the money back but wouldn't return the tyres as he was now too far away. This would mean he still had two perfectly good tyres (and we know the other 3 were ok too) for less than the price of one of them new. OH offered him the money back but only if he returned all 5 tyres.

He threatened court, OH told him he'd see him there. Funnily enough we never heard from him again.
 
have to say within a few hours, if they brought it back I'd have taken it back and refunded if in the same condition.

In addition - I would have measured it before advertising it as you have no real idea what you were selling
