Agricultural linked planning consents

I think it is safe to say that we are ineligible for the condition as it currently stands. The vendor is contacting their planning department (on their own instigation) to see if there is any change of it being lifted, as thier argument is that there is insufficient income avaialble to be generated from the land in question for it to be a main income for anyone - therefore they are having difficulties in selling. However we are not holding our breaths.
 
As I said before we got ours removed after 10 years open non compliancy which we were able to prove plus 3 acres wasn't enough land to earn an income from. We had no problem getting planning for a school and stables over the years.
 
Another option which we have just done in order to purchase our house is not to remove the tie but amend it. Council far happier with this idea. OH is a farrier so we amended it to add Blacksmith into the clause, council accepted no problem (took 6 weeks), so we have been able to go down the route of legally buying (getting a mortgage) and residing in the house.

With our planning app we used examples of other ties being amended by councils across the country, some examples of variations were: equestrian, fishing, contracting and Blacksmith.

Because your are not requesting the tie to be removed councils seems far happier with this

My farrier has just done this with a house he's moving into. His OH doesn't work.
