not willing to discuss that over here.

Sad as it is he is going back.

the money that came is enough for me to buy a slightly cheaper horse outright so no arrangements to be made other than collecting it I should have done this in the first place this is a lesson learnt for sure.

She should still give you the installments you have already paid.

all seems very strange, you seem happy to walk away from the instalments you have already paid (whatever they may be)?

It's very hard to enforce this sort of agreement, whatever the legal or moral rights and wrongs of the situation - better to buy outright in the future if you can or take out a loan and pay that back by instalments.
 
Get photos (Dated) of him before he goes. Take weigh tape measurements. Keep receipts/bank statements. And get a vet/YO lots of people to state that he is in good condition. Vet if possible.

Tell her that as she is in breach of contract that the installment money is required to be returned and when it CLEARS in your bank (not when she says she's sent it) she is welcome to collect the horse.

Don't lose money on it, sounds like she's done this before, maybe not because she loves him, but to make a quick buck...

Get everything in writing.

I think what Amymay is getting at is what percentage of the overall price have you paid... and another thing to start thinking about... please tell me you have reciepts for what you have paid?
 
What a mess, it does sound like some of the story is missing or the owner wouldnt be looking to take the horse back unless they are completely irrational!

It sounds like you have complicated it by complaining about the tack - you are loaning the horse not the tack. Some loan horses come with the headcollar they travelled in and thats it.

I do hope you can sort things out though, it cant be an easy decision to make

If it was me I would pay for the horse outright and have bank payments rather than unofficial arrangements with the owner. Far easier to deal with! I hate to say it though, if this horse was out of your budget and needs work think about what you may end up with if your immediately available budget is much smaller......

Yes it does... OP is the reason you are happy to just hand over the horse without addressing the return of money you have paid tied into the bit you don't want to talk about on here?

Have you actually started to make payments? - I don't know anyone in their rite mind who would just return a horse without ensuring money is returned!
 
I am sad for you that he is going to go back. I agree with you that she probably doesnt want to let him go, however I was interested in what you said that another girl had him on loan before you but he soon was on the market again.

You don't know if the owner had some similar agreement with her about buying him and then took him back?
 
I think whatever the underlying reason, its really sad that you are in a position where you are having to contemplate sending a horse back that you have so obviously clicked with and adore... FWIW, on the face of it, going just on what you have said, I would be fighting to keep him, but it does start with a full and frank conversation from both parties as you intend to do... and if he does go back I would not hand him over until the money I had paid was returned to me.
 
well your previous posts indicate that you have only had him a few months and relations with the owner seem to have deteriorated only in the past few days.

very strange and I suspect we haven't heard the full story so hard to offer useful advice.

whatever the position is, best of luck for getting it sorted out to both your's and the owner's satisfaction.
 
Sometimes you get into things that seem okay initially but then as time goes on you start to regret it. I have been that horse owner I'm afraid. Once, an acquaintance wanted to buy one of my horses that I'd owned for years. She wanted to pay for the horse in installments and she paid the first installment. She rode the horse frequently and in just a short time I could see the horse was becoming unhappy. She had ridden the horse prior to making a payment and she was quiet and rode him nicely but after that first payment was made she was no longer that nice to the horse and to me it almost looked like she was bullying him (and I don't use the bully word flippantly). I was in turmoil as to what to do :( My obvious interest was getting control of my horse back and to make sure he did not go to her so I had to bide my time. She did the same as OP in that she started buying all this expensive stuff (mostly for her other horse) but in doing so she missed the next payment on my horse. That was all I needed to be able to cancel the contract! Which I did immediately. I transferred her initial payment back to her and cancelled the contract in writing. After doing that the relief I felt was immense! I'm not suggesting this is what has happened in the OPs situation but tbh as confusing as her story is I'm sure there has been a LOT left out. I'm sure had my person written her story on H&H then she may have got some sympathy, however if I later came along and told my side of the story then it would even things out. There's always two sides to every story and in my case I was not going to continue with a sale whereby my horse was going to be subjected to the unacceptable behaviour I witnessed.
 
omg this poor girl has just told everyone a huge problem of hers and although its confusing you can clearly tell shes upset, so in reply she gets slated for her grammar really?!! :eek: If you want my advise OP i'd try and take a few mins before calling the owner and think about what you really want, maybe ask her whats upsetting her so much and see if you can sort it? if its the saddle explain that you had a professional saddle fitter out that told you the saddle he came with doesn't fit so that's why he has a new one :) good luck!! x
 
I'm so sorry he is going back :( he is a lovely boy!

You seemed to be getting along great with him too.

Like the others have said, make sure you get your money back before she takes him home. Ring her later and say transfer the money before the weekend and you will prepare him for his leaving at the weekend. Sell the saddle you have just bought. Put that with the money you will be getting back from installments, add that to what you already have and you should be able to buy yourself a decent Horse.

OP if you are not in breach of the agreement to pay half before May then she can't take the horse back. You are being responsible by correctly fitting a saddle and indeed it would be impossible to evaluate the loan with view to buy element if the horse is impeded by a poor saddle.

Hope it all works out for you hun , stand your ground and say you will pay something before christmas if you really love the horse.
 
FfionWinnie maybe the horses owner is not somebody the OP wants to be involved with any more.

If the owner turns up to take the horse but doesn't have the money to return the installments OP has already paid, then at the very least I'd be keeping all tack and equipment to sell to get some of that money back, because once the owner has collected the horse I think you'll have no chance.
