annoyed at my YO

my YO hires out a trailer for £20 which the liveries can hire out. no contract or anything you just ask him and he says whether its booked out that day or not.

anyway last weekend we hired it out and when we got back my mare had scratched the sides (she was very quiet traveling so may have lost balance?

)

YO`s daughter (shes 17, thinks she runs the yard and knows everything wen shes not even horsey

) was there when we unloaded and later told my dad the reason she had scratched the sides was because she wasnt traveling with boots on. WTF!!! shows how much she knows!!

anyway tonight YO calls me over and says i hear you have a few problems last weekend. i thought he meant loading her, then he said there were some marks down the inside. i said i dont know how she did them cos she was traveling quietly

he then said you could have come and told me so i said well your daughter saw and we didnt even think of it. he then made an angry face and then said well we will have to sort something out

he is a real money grabber and TBH i dont like him. knowing him he`ll charge us a load of money to repair it when all you can really do is paint it to make it look better

mum and dad said they arent going to pay him anything and that if he says something to me to tell him to go and see them. so is he in the right or are we?

You are right - no way give him any money! The cost of hiring anything is to cover wear and tear....and that's all that happened.

Ask him if he has business insurance to allow people to pay him to use this trailer??? That should shut him up!

Agree with Tia, the hire charge covers wear and tear unless a contract that says otherwise, which there isn't.

Usually when you hire something there is a contract, so it is difficult without one and do you want to use it again. Why not offer to paint the inside.If you hire things and damage them you are usually liable for the first £100 or something like that.Insurance is usually covered in the cost of the hire but usually has excess, I think you should all check your liability because if the trailer was really badly damaged it could cost you a lot of money. Maybe best not to borrow it again and is it tested and completely safe again it could cause problems

I'd be so upset if I'd paid as little as £20 to hire a trailer and an animal of mine had damaged it. I'd be frantic to try to sort the problem out - obviously others don't feel that way.

Sadly I suspect that's why hiring a trailer round here is very difficult - and costly.

Tell him to do one, no contract referring to terms & conditions so tough luck this time to him.

Can they be certain it was your mare that scratched the sides anyway? Maybe they just didn't notice it before??

they cant make you pay any money anyway for the rasons mentioned above. If it were possible I'd move yards, dont like sound of your YO.

TBH, I would offer to help rectify. Even if it is a small scratch the gesture of showing that you understand the value of it being someone elses property. If I scratched the trailer I would repair it the best I could personally.

I feel you should be the one trying to make amends to be honest, it was your horse that did the damage, so it's up to you to make it right.
If all it needs is some rubbing down and painting, what's the problem?
Sorry I don't think £20 covers wear and tear sufficiently, hire yes, but not damage to the trailer.
If this were me I would rectify the damage, otherwise he may well sell the trailer and then you all lose out..and drop the hint a proper contract would be a good idea, for all you know you could get sued for the whole trailer if it got severely damaged.. I bet his insurance (if he has any) won't allow hire at all..

I would offer to help him repaint it but no contract, he hasnt a leg to stand on and doubt he has relevant insurance.

tbh, I'd not be using his trailer as how do you know the floor is sound etc.? Think of how many people are using that trailer...
With no contract I'd not be paying anything as I suspect he has no business insurance.

I would have definatly told him if my horse had done that to his trailer and I would also offer to pay to repair the damage.

If someone borrowed my box and damaged it I would be mortified. £20 isnt a lot to hire a trailer and in most cases it wont be enough to cover any damages.

I can't believe you're even considering not paying to repair the damage. It's common decency that if you borrow something and damage it that you pay to put it right. Imagine if someone broke something of yours and then refused to pay to repair it.

With a proper hire contract any damage would be paid for by the insurance but you'd be expected to pay the excess... usually £100.

Do the right thing!

Yes and if she had borrowed it then this would be exactly what I would advise too.....she didn't; she hired it. Hiring costs cover wear and tear and it is up to the hirer to set a price which covers this....that isn't her problem that he chose to set the hire price so low.

I am obviously not getting the same impression as some of you - I thought she said the horse scratched the inside of the trailer? Sorry but that is minor wear and tear to me and there is no way I'd expect anyone to "repair" that if they were to borrow, or hire, my trailer. A great big gaping hole ..... yes, but a scratch? No.
