What would you do?

I bought, in good faith, after being recommended to an Ebay seller, to buy some new breeches. I bid for a pair of Cavallo ones, and got them for £32.99. Bargain! So just because it was a bargain, I didn't expect them to be copies or snide ones, whatever you want to call them. They arrived yesterday and I looked at them compared to my own Cavallo breeches and even though they have tags on etc, the quality is **** compared to proper Cavallo's and even the logo on the button is incorrect and on the label at the back.

I am really pissed off about this. I bought them in good faith thinking they were real and above board.

What would you do, send them back or is it just expected, because it is Ebay that I wouldn't be getting a bargain just "fakes"?

Hope this makes sense, sorry it is a bit of a rant and ramble!!
 
Commenting from experience, the seller may not be aware they are fakes. I don't own a pair of Cavallo's, so say I had bought them and then sold them on if they didn't fit, I would be selling in all innocence.

I know there are some rip off merchants on ebay as I have sold to one and it wasn't a good experience for me.

I look at it like this - there aren't many bargains around these days.
 
It depends on how they were described. If they were described as Cavallo breeches, new and unused then I would contact the seller first, asking for a refund and if he doesn't sort it out, let Ebay know. It should not be a problem getting your money back.

If they were described differently, e.g. "Cavallo style breeches" or mispelled "Cavala breeches" then it may be that you got sent what you bought in which case you have less of a comeback. Is the seller a shop or trade? In that case you can return for a refund within 14 days under the Sale of Goods Act. If they are a private individual I think you are stuck with them because they were not misdescribed.
 
If the seller is a business then take the breeches to a saddler & have them verified as a fake pair, you can then file a claim with Paypal (with the evidence that they are fake) who will tell you to destroy the breeches and you will be refunded.

If the seller is a private individual, as Mickeymoo says, they may not be aware, so if that is the case I would personally contact the seller first & ask for a refund - although technically you should do as above.
