Another ebay rant - unreasonable buyer :(

We all seem to be at it at the moment.

In 7 years of ebaying I have come across my first horrible unreasonable buyer.

I sold a brand new Joules top with all tags etc on ebay, it was bought for me as a gift by a relative but they under-estimated my size and it was too small. It came from a local tack shop.

Listed top as the size stated on the label on the top and the tag. Get an email tonight saying no way is the top the size labelled it is more like a size smaller and that she will be returning it to my address for a refund :(

My listing states no refunds.

I have politely replied saying that the top was sold as described, that I could not be held responsible if it did not fit and that I did not accept returns.

Looked at her feedback history to find she has bought jods, dresses etc a size bigger than the top bought from me and really feel like she got it, it was too small, and now she is trying her luck to get a refund.

Really not happy and don't know what to do. I tried to find a way to report her to ebay but everything is geared towards helping buyers. I'm worried the top will now be winging its way back to me and paypal will steal the money back off me... :(

Argh!

Any advice gratefully received!
 
mmmm........sounds like she is one of those people who won't admit to themselves what size they really are! Stick to your guns and see what happens, I cannot see how they can take the money off you when you have sold the top honestly.
 
Same thing happened to me the one and only time I have sold something on Ebay. It was a medium wide saddle and the buyer claimed it was a narrower width than stated. I told her to lodge a dispute with ebay/paypal, and rather than doing this, she re-listed it - to me this was an admission that she was trying to pull a fast one. I think the saddle just did not fit her horse and she didn't want to lose any money on it. As it happens, she actually made more than she paid!
 
Don't really have any useful advice to offer I'm afraid (apart from offering my sympathies!), but I always thought it was a case of "caveat emptor" when buying from a private seller on eBay.

I don't sell on it, but have bought a few things to various effect - had a jacket delivered that, when it arrived, wasn't exactly as expected, but I just thought "oh ****, no likely as much as I thought I did".

I just don't understand people like your buyer - maybe there are charlatans on eBay and they've been stung before, but to accuse you of falsifying sizes is a bit much! Maybe they didn't realise how much Joules sizing varies depending on the style of the top (I know I go up a size if it's a fitted one), but that's not your fault!

I'm so cross I am definately not going to back down on this.

I bought some jean jods on ebay a few months ago 2 sizes bigger than I am normally after buying a pair my size which were too small. They were also too small for me. I never went back to the seller and said these are not the size they are labelled as give me a refund. I accepted that the style and cut did not fit my womanly peachy bottomed figure and resold them.

I have contacted ebay and reported her for "feedback extortion" as she said in her email she would still leave me positive feedback once she had her refund, thus implying she would leave negative if I did not.

If she gives me negative feedback I will look into how to get ebay to remove it.

killikyle - I think this may be exactly the problem this was a fitted Joules polo top rather than a baggy one...
 
If you've stated 'no refunds' then she can't send it back to you and expect her money back! Unfortunately ebay is geared towards buyers (because, let's face it, there *are* unscrupulous sellers on there too), but I do sometimes wish they'd be a bit fairer.
 
ive just had a big brawl with a buyer on ebay and learnt alot. btw i won my dispute sold a set of car wheels buyer decided they was bent buckled dent u name it these wheels where it
right my advice would be to denie her money back weatheir she sent the item back or not wait till she makes a dispute (your money is safe it will be held in a account in the middle sorta thing) when she makes a dispute you have 10 days in witch to agree a ending basically stick to your guns explain once again in the dispute that its size on the ticket and not your fault after 10 days you can then send the dispute to ebay and within 48-72 hrs (mines was under 24hrs) after ebay make a decision cant see it going her way you will be acredited your money
as for if she sent the item back you should note this in the dispute within the 10 days and they will probs add on the extra postage back to her or help with this matter

If she has already sent the item back then she is unlikely to win any PayPal dispute she opens. If she has already sent the item back without using a trackable method then she won't win any PayPal dispute she opens as there is no record the item ever reached you.
 
I know its annoying when someone changes their minds but why wont you accept returns?
If its returned in the same condition you could take of some off the amount to cover your fees, re listing/ paypal etc.

Lots of these makes of clothes tend to be sized differently so it could have been a genuine mistake.
 
Ebay buyeres can be such a hassle. Last year I sold a 70 year old side saddle girth. The leather was in great condition but a couple of little bits of wear on the buckles (as you may well expect) I started it at 99p and someone bid up to £10 for it. I was then promptly left negative feedback as it was "rusty"! Sorry but something that is practically and antique isn't going to be like new! I also sold an old lunging caverson for the grand sum of 99p and had a similar experience! No where was it described as "new" and was perfectly useable. People are such arses I really do give up!
 
I've done the same as blucanoo suggests before, rec'd the item back then taken off the listing fees, final value fees, paypal fees and postage etc before refunding, that way if she lodges a dispute it clearly shows that she has already had a refund for the item and you are not out of pocket at all.
 
I can sympathise!! We run an ebay shop and im not saying we are perfect but some buyers, begger belief i would never behave in such a way, If i order the wrong size, i feel thats my fault, why should they loose money (posting and re posting etc) for my mistake.

I once sold a Jeffries saddle online which i measured the distance between D ring to D ring and didnt claim to know the precise "N, M" ETC. I just measured what i could.
Some one bought the saddle, and then tried to tell me i was "endangering her horse" and "shouldnt be alowed near horses as i should be reported to trading standards for selling a saddle "too narrow for ANY horse" ....apparently...
Even though this was a USED saddle and i made no claim to it fitting her said horse.

She was just annoyed that it wasnt as much as a bargain as she was thinking, since it was a jeffries and she got it cheap. The way she attacked us, saying it wasnt suitable for any animal was just outrageous.

In the end she just went away when she realised we didnt back down.
 
All Sympathies hun. Stick to your guns. You state no refunds. Item was as described. That is the problem with buying clothing esp without seeing it. If you have kept to your side of the bargain then she should stick to hers!

Just had a positive outcome when I phoned Ebay for advice. Perhaps have a word with them and see what they recommend.
 
I had issues when I sold a prolite numnah in used condition and the buyer wanted a refund as it had horse hair on it!!! I had washed it (twice) but some remained. She opened a case against me that it wasn't as described and I couldn't beleive it when e-bay found in her favour. Even though she had left feedback saying how pleased she was with it. Gggrrrrrrrrr
 
I have also had the same problem. How long do the buyers have to lodge a complaint with ebay then or is it indefinate?

I told my buyer there is no way I am going to refund her, that was 3 weeks ago and I have heard nothing since ?
 
Ok ,if she sends the top back,REFUSE to accept,if you have to sign for it. In order to get a refund she has to send the item back recorded delivery. DO NOT sign for it.
Let her open a dispute if shes not happy.Sounds like buyers remorse.Believe me I have had some horrible buyers on ebay. Trying it on all the time.

I had a similar problem a week ago. Sold some well used mountain horse boots. Stated well used etc. Started at £10. Couldn't believe it when the end bid was £75!. Then buyer didn't pay, got her dad to email me and said parents had bought her a new pair of these boots the day before??? and could I offer them to the 2nd highest buyer. i did this but got no reply and said she had to pay for them as she won. Dad started emailing me very arsey. Paid then 1 day later lodged a case that they hadn't arrived!! I tracked order and they hadn't accepted them. Emailed them this they they said could I tell them where the sorting office was in their area - er no I live 300miles away! Lol. Then I get another case opened against me saying they are not as described and they apparently didn't belive I had only used them for 6 months - well I ride 2 hours each day /hunted / etc in them - stated well used etc. Blackmailed about the feed back (as OP) and I had them back and refunded as I was fed up of the hassle and nasty emails from this girls dad. Back on ebay now! Have now stated no returns. Worst ebayer ever - did everything to get money back - and going through their history it seems they do it alot. I can't find anywhere to report them to ebay though to stop them doing this. Cost me £10 in postage too!!
 
Also, does your original photo show the size and tag? As you could use this in your defence to prove that the top was the size you stated.
 
Ive bought loads off Ebay, many things not fitting but thats my fault. Joules fitted styles IMO come up small. You listed the size correctly so its tough it doesnt fit her. I cant believe some people. I get miffed when something arrives as barely used or excellent condition and it when it arrives its well worn or tatty. Problem with ebay is the postage costs, so sending back costs even more so its just not worth it.
I reckon you will win any dispute as item was listed correctly.

Why don't you let her send it back and also tell her she needs to give the x amount it cost in ebay fees. Wait until closer to xmas and sell your Joules top again. You'll get more money!

My dad had this similar problem and paypal actually took the money off him and refunded the customer without his knowledge!

I buy and sell on ebay a fair amount and come across people that just want to piss and moan.

Buyer has emailed me today now accusing me of selling a fake Joules top! Guess they decided the sizing angle wasn't going to work so thought they would try something else.

I called ebay - free phone no is on crazyfriesian's post and spoke to a human as I cannot lodge a dispute against a buyer online. I have explained the situation inc the accusation that this is a fake and they have made a note on my file so hopefully this will help when the buyer opens the dispute they have threatened me with.

I even called Joules to ask if they could give me the measurements but they said as this is last season's style they couldn't give me the exact ones but that all stock is quality controlled and so the size on the labels in the top are the size it is!

Item was brand new with tags and bought from a local tack shop. I have told the buyer if they return the item on the grounds it is a fake I will be sending it to Joules to confirm whether it is genuine or not before issuing any refund and that if it is fake I will be involving trading standards as it was bought from a tack shop (even gave her the name of the shop.)

I have already told my parents, whose address my ebay account is registered to, not to accept any parcels for me and to tell the postman to return to sender!

Honestly I do not believe some people. I'm hoping that she will realise that it is actually very naughty to make such accusations and get back in their box and leave me alone!

Makes me not want to sell on ebay ever again. Sellers have no protection against bad buyers :(

For those of you who have suffered above and want to report a buyer I would phone ebay, speak to a human and explain the situation.
 
If she sends it back recorded, accept it. The buyer only has to prove they tried to return the top, which the tracking number will do. If you don't accept it the top will be returned to her, and if ebay award her a refund she will have your money and your top.
 
Palamino Pony I would report her for feedback blackmail, if you search in help it will tell you what to do.

I sell for a living on ebay and just give refunds now to save hassle as ebay always refund buyer.Paypal are even worse. My best one was last xmas after ebay refunded a buyer 4 working days after they paid for it???

One we got recently though was someone paid by cheque for saddle, cheque cleared and emailed them to so courier would collect tues or weds. Weds the cheque bounces 2 days after clearing. Thank god I had a box shortage and hadnt yet sent the saddle. Needless to say they had 0 feedback and I reported them to ebay
 
If item isnt as describe then i agree a full refunded it should be given.

If the buyer has changed their minds or some other reason doesnt want them, then give a refund, minus postage costs, ebay/sell and paypal fees.
this way you are not out of pocket, you get the item back and can sell again.
