Quick question,
I have a small company in the U.K. I have decided to give one of the girls a small hourly pay rise she works hard has a couple of kids and is struggling at the moment I felt sorry for her.
Said girl has now told her co-worker that she has had a pay rise why why why ! The college is now complaining that its discrimination and says she wants equal pay !! Wish I had now not given the girl a pay rise.
I am inclined to tell her if she is not happy she is fee to leave ! I hate to be forced to do any thing.
I am sure it is not discrimination, surly its up to the employer to pay an employee what they want as long as its above minimum wage.
Comments.......

I am not in HR, but I would think as long as you are paying the other girl the minimum wage, surely pay rises are at your discretion? x

you are free to pay them what ever you like as long as its above NMW

its quite simple girl A is proving her worth and has got a pay rise girl B aint working so hard so aint getting one if she dont like it she can leave there will be 100 people wanting her job

Agreed - you can pay individuals what you like unless you have published documents/contracts that state that employees are on levels of pay according to their position. If these girls are the same position then you can see why the other one might feel demotivated.

Has the first girl worked harder than the other? Would it be worth offering the second girl the same money of she proves herself over the coming months. It is up to you and you will fill her place if she decides to leave but I wouldn't do exactly the same job as someone else, work just as hard and expect to be paid less.

not in HR but work with HR to manage my department so have dealt with lots of issues around pay, but within a large FTSE 100 so have very defined processes so excuse if sounds overly formal and yours is more casual.

Do both girls do same job, do you do annual pay reviews/pay rises in your co? Do they usually (if have done before) have pay parity?

If both girls do same job and you have not made a fair review of both when awarding a pay rise then i would say girl b could have a case. Of course girl a is stupid to discuss this with her in first place, what did she think could happen?

TBH the business is running at a small loss at the moment. The pay rise was compassion. Both girls work hard and do the same job. However girl B is a bit of a trouble maker so I would be happy if she quits. Odds are she will not quit as its an unskilled job and its a rural location so not that many jobs about.

Its not discrimination unless you havent given the other girl a pay rise because of a reason such as race, disability, sexual orientation etc.

You have the right to give an employee and pay rise and not to another, as long as both are above the national minimum wage which for over 21's is £6.08 per hour.

Your not doing anything wrong by giving one an increase and not another, it happens all the time in the work place.

There isnt stopping employees sharing their salary unfortunatley, you can ask them not to discuss it with others, but they can if they want to.

If you need any further clarification give ACAS a call or for details on pay you can look on directgov

How long has girl B been employed with you?

Do you have any disciplinary procedures? just thinking if shes a trouble maker.... :)

Well in that case - stick to your guns. It is entirely up to you at the end of the day and it might just be the thing to get her to walk. If she doesn't you can use it as a reason to encourage her to buck her ideas up. Tell her it was a performance related pay rise.

Armas, I don't suppose you do personal loans/charity cases/good deeds? :)

Girl A has been working for 3 years girl B 1.5 years.
Girl B received a pay rise last year girl A did not.

Annual pay reviews are being carried out at the moment which was what prompted me to give a pay rise to girl A

Frankly I would be happy if girl B left !

Note to self loose the compassion

I wouldnt worry about girl B's bitching, people throw words about that they dont really understand the meaning of in the eyes of an ET.

I'd keep an eye on the behaviour you mentioned earlier, and potentially review it under your disciplinary procedures (depending on the circumstances) and/or manage her performance if its not up to scratch?!? :)

you never know she might be so miffed about the other girls increase that she leaves!
