any update on TIC TOC . did the rspca persue this?

Even if the RSPCA were to pursue this case the fact that some well meaning but badly advised people chose to put it on facebook and then on Youtube so it went viral and is now on horse forums all over the world has pretty much lost any hope of it ever reaching a court
No matter how deplorable the dealers were in how they treated the horse under UK law they are still entitled to a fair trial and with the amount of bad publicity they've this could not happen now as opinion is so biased against them.
It would have had a chance if the person who took the video had gone straight to the RSPCA and it had all been kept under wraps until the trial was done and dusted. That would have been the time to then expose them for the sort of people they are.
They will no doubt walk way from this and as there are always people looking to get rid of horses they no longer want there will always be people like this who buy them cheaply - no questions asked - and sell them on to some other unsuspecting gullible person
Anone who doesnt have a full PPE with blood tests these days is just asking to get taken in if they dont 100% know and trust the seller

Eh, the numpties in the video put their own video on YouTube themselves. Stupid as they are I'm thinking they wouldn't have reported themselves to the RSPCA:rolleyes:
 
There is one big advantage of taking someone to the small claims court and getting a county court judgment on them. Once they have a county court judgment they will then come up in any searches that anyone makes on them. This means that any credit search carried out on them will reveal previous court judgments and make it much more difficult for them to get any credit in the future.

also once you have the judgement against her you can hire sheriffs of the court to pursue her, yes she runs etc but he is within his rights to take goods to the value im sure horses wagons etc would be taken and therefore detrimental to her business.

there are so many of these idiots around because we keep lining their pockets should be a name and shame website people could view of all dealers etc in areas with feed back, anyhow it is def worth persuing but people give up hence they get away with it !
 
you cannot take goods to the value of . taking a horse would be stealing . taking bloods doesnt cover you if they refuse to pay and they wouldnt be applying for any credit anyway ! cash cash and cash ! however i cannot see why the video or public opinion would make any difference to a case that the rspca would have against them as it wouldnt be heard by a jury . this video should make no difference at all.
 
And it's going to be difficult to prove beyond reasonable doubt that any marks on the horse were due to being beaten at that yard, after a delay of at least a day (two?) and transporting the horse from one yard to the other.

No delay - horse was taken straight from the dealers yard to a waiting vet.
 
I dont think anyone would pay for a full PPE and blood tests unless it was an expensive enough horse!! And I really think the RSPCA, in the current economic climate, could better spend their funds than persuing this case. If it was necessary to take these people to court, surely it should be up to Tic-Tocs owners do do it-after all, they sent him there, so why should public money, in the form of RSPCA donations, be used??

If this was the case then none of the high profile cases we read about every day in the papers would ever get to court including Mr Grey. Although Tictoc and these dealers were talked about within the horse world for a few days, there are plenty of magistrates, judges and joe public to form a jury that would have no idea of the case at all. A jury is selected on being able to demonstrate they are able to provide a verdict that has not been biased by hearing things before they set foot in the court room.

In the uk this type of case is most likely to be held in a magistrates court , there is no jury so the publicity is no issue.
Although there has been a bit debate on the horsey forums abour this case it's nothing in comparison to the interest generated big public interest cases in the media and we have safe trials all the time in such cases ,the jury once selected is directed by the judge as to their responsibilities .
I don't think this ever come to court, but the reason for that is nothing to do with publicity and a fair trial.

I think the biggest plus thats come out of this is that people now know her name, and have made the effort to use google and FB to put a face to that name.
It will reduce the likelyhood of someone buying any animal from her, and as such will damage her business.
Sadly however it had to come at the expense of a very lovely young horse.

They are entitled to a jury trial if they elect for one, anyone can. I can't decide in this case whether that would be in their interests or not :confused:


It won't be coming to court though, for all the reasons that have already been given.
