I am looking at getting a horse on long term loan and have been advised to write a contract up. What should i include? Any examples or advice is appreciated.
I did have one but thrown it away since my loan ended! It was a really good comprehensive one. From memory it had the following things in it (BTW it was written by the owner of the horse I had on loan):
- Address and contact details of both parties
- Date of the start of the loan
- Trial period of 6 months, after which loan continues or horse given/taken back
- full description of the horse
- details of current vet, farrier, dentist etc and whether or not the loanee can change them with or without prior consent of the owner
- a list of all tack etc that comes with the horse
- a list of all known vices and health issues, allergies
- a list of activities that the horse can and can't partake in
- who is responsible for paying the horse insurance, vet bills, farrier etc
- where the horse is to be kept and whether the horse can be moved
- what sort of notice, if any, the owner needs to give to see the horse
- what period of notice the loanee must give if returning the horse and similarly what notice the owner needs to give if they want the horse back
- a list of any feed/exercise regimes that must be adhered to
- both parties should sign it and the owner of my horse wanted it signed by a witness too (!)
I'm sure there's probably something vital that I've forgotten but that should hopefully give you some ideas.
Oo, one thing I forgot that was in my contract was that I was allowed to make the decision of having the horse put to sleep if I couldn't contact the owner and a decision had to be made. But it did state in all emergencies she should be contacted first if possible.
