Stacey i know you 2 are good friends so i wud keep out of my business if i was u pls! He sold me a horse unfit for the purpose of eventing,Its failed 2 vettings now (i have tried hard for past 2 mths to sell it on at a huge loss),oh and it rears(has done from 6 days after buying it,wont jump a stick let alone a small log,unsafe to hack)and Barry has decided to vanish,(not answer my calls,letters)BUT he cant hide!
Im very angry now and going the legal route and have lots of back-up to help prove its not me,its the horse! Ive been lied 2 by Barry from the day i tried the horse(vet will confirm this)&i dont f**king care who knows the full story now,as Barry is clearly a dodgey dealer whos f*ll of lies ! He shud have taken nag back when i 1st called him explaining situ,but he's choosen to play nasty games! im the one 5k out of pocket&no horse to ride!mad:

Did you have the horse vetted before you bought it or once you bought it and then found it to have problems. If you bought it unvetted then with regards to its soundness I am not sure you would have any comeback. However, if the horse is not as described( Ie if they described it as safe and it stands up) then you might.

I buy horses without getting them vetted - always have done, so I can't comment on that one!

Did you not try the horse before you bought it? Surely it's jumping, hacking and rearing issues would of come to light then?

If you are intending to go down the legal road slanging matches won't help. I wouldnt go into anymore detail so publicly. If he is a dodge dealer - wait until you've took the bugger to court before you inform every tom dick and harry.

Prudence did get him vetted when she brought him and he passed...although since trying to sell him on and having 2/3 further vettings which he has failed completely the vets say something was obviously done to begin with!!! Prudence isnt stupid, she events and knows her stuff..just got 'duped' on this occasion!!!

I dont blame Prudence for ACCIDENTLY getting angry and posting on here about it, its just got ridiculous to be honest and bless her just needs to be sorted out....if you were in her position im sure you'd all get angry to....

I hadnt mentioned names till now as given dealer over 2-3 mths to help/contact me and take horse back&pay me back(he obv has not) BUT theres obv aload of groupies who seem to think wat he has done is right???(i got warned not to ruin his reputation last time i posted on here re advice on small claims) Im well within my right to tell the truth and name and shame.(it happened to me so cud happen to you,)B4 buying, I asked all the right questions&took wks choosing the right a horse,sumone recommended Barry&the horse to me! yes horse was tried ONCE b4 i had it vetted,was told i cudnt hack it out(I was pressured by seller to have horse vetted the nxt day and taken home following day,or he was selling it to allllll the others he had lined up to buy it-silly me eh,i shud have seen this coming,D'oh!), u can not tell what a horse is like the day u try it,these things come out a wk or so after getting the animal home(hence your consumer rights&trade description act when buying from dealer).I bought it to event,hack,Rc stuff and even asked if it reared,answer was NO,it sounded a good match for what i wanted it for. Im very angry and why shud this b&stard get away with selling a dud horse(bless it) knowing it had probs,issues then ignore me when it started to go wrong within 6 days of owning it.!now im told NO-way wud it have passed the vetting orig (i had it 5 staged vetted by his vet)without being given drugs?(just to add to the prob). If we let people like this get away with things like this,then the bad apples get away with it scott free(hence this post).He is a dealer and should have taken horse back and paid me or exchanged,but he refused to do this. !

. Lets not 4get about this poor bl*8dy horse whos obv had a rotten time&been sold on without any consideration for its welfare! Poor thing! He also told me he had it 2 mths or so,but now i know he had just taken it on to sell just a wk or so b4 i tried it???.who knows the truth??But ive been taken for a MUG!!boy has he got me wrong! im now a vicious angry old lady!!!!

Was that directly at Prudence or overall??? If direct, i can say for her, certainly not like the 10th horse, sigh!! she sold her lovely event mare to a nice home and has tried a few since, the ones she has tried, the owners have usually lied about things or they failed the vettings!!! All she wants is a nice event horse to bring on....

oh dear as predicted people on here who obv know this dealer are taking sides! not sure wat ur getting at?but this horse is the only horse ive bought with probs,other failed vetting so i didnt buy.Kept last horse 3 yrs and did very well,last horse 15 yrs b4 that and i bred last yrs young event horse! not that its anything to do with my post)So pls dont talk about me when u clearly dont know me or this situ.isnt H&H forum 4 things like this & 2 help/ warn others?and get advice?its not a b*tching site to get caty! Jeremy springer is for this kind of b&tching! OK Stopping now,getting VERY childish. Im 36 not 16!!!:p

Well I don't know the dealer at all and this is just my opinion, but if you were only allowed to try him once, and didn't even hack him out then you should have had the alarm bells ringing to start with.

The comeback is with the vet. The animal passed the first vetting. Now it's not fit for purpose when the vet said it was. I take it you used your own vet and not the dealers?

Sorry but you seem to have been incredibly niave here. I doubt you have any comeback except with the vet.

I'm very aware that you can't always tell what a horse is going to be like until you get it home.

You didn't actually do much when you went to try it. What did you expect? When he said you couldnt hack, didn't that send your alarm bells into over drive?

Did he insist on his vet doing the vetting?

When you had the original vetting done - were bloods taken? If they were I would see if they can be sent off to be checked for bute/sedative etc. You will have to pay extra to have that done but I think its the only way you will be able to get any further forward with this.

Buying from a horse dealer (a dealer is classed as selling two or more horses a year) and barry has sold a few as his adds are on the internet) gives the purchaser the most protection possible under the Sales of Goods Act. The Act states that the goods must be of satisfactory quality, fit for purpose and match their description. However, you need to prove that the horse suffered with ill health prior to your purchase and that the dealer was aware of this. Facts that would need to be taken into consideration would include;
How long the dealer had him before he sold him to you.
Whether you had him vetted prior to purchase.
Whether the dealer made you aware of any ailments that the horse suffered.
Whether your vet is of the opinion that the horse's medical problems have been present for a period of time, making them apparent to the dealer.
If it can be established though veterinary opinion that, on the balance of probabilities, the horse was suffering ill health prior to your purchase, it may invalidate the sale and make it possible for you to claim back the losses that you've suffered.

I would presume that you asked for blood samples to be taken at the time of the vetting. These are stored for 6 months so if the horse was on bute etc. or doped as the vet claims it was, then these should be tested. It will protect the vet, protect you and if the horse is proved to have been on medication there should be no issue with a court finding you to be in the right.

Im hardly Niave(u obv dont know me)Horse was recommeded by someone(friend of a friend who wishes to stay out of this)was told this Barry was a good guy,yes i tried horse once,asked to hack it but cudnt as nr main rd.Took someone with me when trying it.Had it 5 stage vetted& seller declared to me&vet is was sound&vice free(we have this in writting on vets report)!I cud have tried horse 5 times at his yard and it wudnt have put a foot wrong as this Barry is a pro rider and horse prob knew not to put a foot wrong.May i add that 4 the 2 girls that seem to think im niave as didnt try it more than once,as ive said,i never expected me to be caught out like this.Ive had horse all my life,bought and sold a few.BUT buying from a dealer whos well known, i thought gave me more protection IF these prob cropped up.THATS my point!! These things happen,horse's r NOT machines.My prob is dealer wudnt take horse back without giving me cash back&refused to exchange.

I am amazed at the tone of some of the posts towards prudence in what must be an awful situation.
If what Prudence has said in her posts is true then this dealer regardless of who knows him shouldn't be allowed to get away with it.

Unfortunately instances like this happen regardless of how experience we think we are , and the signs of a good dealer is how they rectify the problem, he clearly doesn't seem bothered about his reputation.

I hope Prudence you sort this awful mess out and I agree with you that in the middle of all this is a poor horse who it would appear has a very rocky future if at all.

I would like to point out I know neither Prudence or the dealer in question.

You are correct, I do not know you. I only have what and how you post on this forum to go with.

By posting what you have you have opened yourself up to opinion. You have to like it, lump it, or not post.

I'm sorry, but being near a main road is no excuse to not hack the horse. If you were serious about buying the horse then you could have had it boxed to a place of your choosing to hack/ride in a different place etc. This would then have got you round the 'horse not playing up as it knows the dealer' situation. Having someone else with you at the time of the viewing is not enough, not is going on other people's views/his reputation. You have to take every precaution to pretect yourself, which you haven't.

You haven't responded to whether you had bloods taken, so can only assume you haven't. Horse could well have been doped, but you have no proof of this.

Agree that you need to contact the vet who did the initial vetting in the first instance to see where you stand.

Airing your grievences in a public forum opens up your situation for comment. I suspect you feel annoyed at the mistakes you have made and are lashing out in anger at people who don't know you.

Not here to make you feel bad, as must be a horrid situation to be in, but instead of jumping up and down and being 'i'll scweem and scweem and scweem' you need to cover your back and go about this in the correct way.

I hope you get the outcome you want.

OMG,this site really gets going doesnt it. I put the orig postup 1 to get to know more on this dealer(which i now have)2. for advice from peps who have been here,(u wudnt believe the posts ive had back with EXPERIENCED horsy folk who have been robbed and taken 4 a ride(excuse the pun).Mainly i wanted to try and warn others on how nasty these so called dealers,horse producers can be. Yes bloods were taken,yes im an experienced rider,YES i was silly to buy after trying once(but was i?,horse ticked all the right boxes going on sellers chit-chat).PLUS id tried prob 10 plus and been searching for 2 mths near&far for a nice lil event/allround type! I dont think theres many sellers/dealers out-there who wud allow a horse they r selling to be taken away from its yard for a buyer to try??ive not come across any.This will get sorted im sure,he cant get away with it as i have done everything by the book and have back-up of vets and witnesses.Its just a case of time&MORE hassel 4 me.Thanks 4 ALL posts,even the neg ones!! I had no idea how hard it was to buy a horse from an honest seller(never use to be like this),i clearly still hav NO idea hehehe(i have since found a cracker )(

I've known several occasions where the horse my OH was intending to buy was boxed (by the seller) to a local XC course and arena, so that we could see how it would react out of its natural environment (and of course to try it XC, but then this might only be a northern thing. Nothing wrong in asking to do this. If the seller is serious, along with the buyer, in the horse being the right one for you.

I'm glad you had bloods taken, this is your first point for evidence that something underhand has gone on.

I never said you weren't. You may be an experienced rider, does that cloud ones judgement when, having trawled around looking for the right horse? Maybe.

I can imagine it is very time consuming and is lots of hassle, but getting annoyed at people on an internet forum who are only trying to get to the root of the argument in order to give advice is not conjusive to sorting the problem out. Nor is getting arsey with people who don't share your pov.

There are some people on this forum who seem to like nothing better than putting the knife in at the slightest opportunity. Shame on you, I am sure you know who you are. How about a bit of moral support for poor old Prudunce. It's a horrible situation to be in but then again I guess you are all much too clever and experienced to ever get caught out like this! I know how she feels, I have just taken a dealer to court and won my case and it's all been an extremely stressful experience which went on for months. I still haven't recovered any money yet. So have a bit of sympathy, you never know it might happen to you one day, heaven forbid.
