Anyone successfully claimed from BHS Gold/other for liability?

Further to the insurance thread - has anyone ever made a claim on BHS Gold or any other 3rd party liability policy and was it successful? Just out of interest . . .
 
I've thankfully never had to claim (probably shouldn't be replying to this!) but apparently the BHS will only pay out providing you aren't covered on any other policy, so worth checking to see if this is the case as you may already be covered on a household policy.
 
My beloved daughter (then 11) left open a field gate, resulting in my new horse being hit by a car. As renting at the time, had no house insurance, but was insured 3rd party through BDS. Car was a w/o, although driver was not badly injured (thank goodness). They paid out, no problems.

I was left with the vets bills, of course, but can't complain at just under £900 for 4 hours suturing by car headlight (until 2am!), follow up visits, 2 lots of x-rays, drugs etc.

Bigger problem is that I now have a 90% sound horse, who I am morally obliged to keep forever!
 
I don't know the full story as I have never pushed him too hard to tell me what happened, but my boyfriend's Mum had an accident with their trailer (it snaked when she was cut up) and his horse was thrown out of the trailer and on to the motorway.

He caused a pile up and several people were injured, Pony Club paid the costs of being sued by those injured drivers/passengers.
 
Yep, through the BHS when my horse went bonkers (still not sure exactly why) and jumped onto a car. I was worried sick about the whole thing but it was straightforward in the end. Only one form to fill in too!
 
Yes I have and it is true you must check for other liability insurance first. Very helpful, kind and quick.

My horse and another had a spat and kicked each other, unfortunately mine was freshly shod at the time (barefoot now) and had sharp nails still... Bad farrier. So ripped her skin near her stifle. Needed stitches.

Underwritten by another company obviously and we did have loads of questions about it but they paid 3rd party very promptly.
 
There is no legal requirement to insure horses in Great Britain.

However ........under the animals act 1971 the horse owner is liable for the animals action. In other words owners/keepers have strict liability for accidents or injuries caused by their horses.

In 2003 a landmark judgement (Mirvahedy v Henley) by the House of Lords placed responsibility on the owners of horses who escaped from a secure field and caused injuries to a motorist. The ruling set a precedent under the Animals Act making the owner of a horse or other animal that could potentialy cause damage, liable for the animals action, no matter what precautions were taken to prevent it.

It was made quite clear that horse owners should ensure that they have third party public liability cover to no less a sum of £10,000,000. (Ten million pounds). Most insurers do not provide insurance to this cover so it is essential that horse owners check their policy very carefully.

This levelof insurance is provided if you are a Gold member of the British Horse Society.

This is really helpful because I'm about to renew my BHS gold membership just to have the third party but now worried because I'm also a memeber of BE who do offer some third party but not to this level (AFAIK). As I'm a BE member so have their insurance cover does that mean that BHS wouldn't pay out even if the BE insurance didn't cover it fully? If this is the case what's the solution?

you have answered your own question. if you are a member of BE, you canopt out of 3rd party. Opt out and get bhs gold.
 
I was told by BHS membership helpline - but would recommend you do check before, god forbid ever needing it, that BHS Gold would cover the amount in excess of your other policy up to their own limit in the event of a claim.

Does anyone know if NFU House Insurance covers horse accidents through the Public Liability? I keep meaning to ring NFU but always remember at odd times like 8pm ona friday!
