Arrest Warrent for Neglect

What I find most disturbing about this case is that the woman previously had only received an adult caution (whatever that is) for neglecting two ponies so badly they had to be destroyed.

Why has she now only received a 10 year ban? Why is she not banned for life??

What on earth is wrong with this country - I absolutely despair, I really do.

You see, there is no pleasing people.

Usually the complaint is that the RSPCA do nothing, now they have done something - and it still isn't enough.

I'm delighted that they took her to court, and the fact that she had already been warned on a previous occasion no doubt added to the strength of the prosecution case in this instance (they might not have had enough evidence for the previous job)

Whether it is 10 years or a life ban doesn't really matter, the fact is something has been done and a result has been acheived.

This is about the law being an Ass, not the RSPCA - I totally applaud them for getting a prosecution. I just wish that the law was on the side of the animals, not the bloomin b*st*rds that are responsible for the cruelty in the first place.

I think that the way it works though is that at some level the RSPCA will have been involved.

Anyway - my gripe is not about the charities involved - rather the law.

In a world where you can receive a sentence of 2 years imprisonment for rape, a conditional caution for stealing thousands and a fixed penalty ticket for being in possession of drugs, the 10 year ban appears proportionate
 
I think this case highlights very well how completely useless the law is with regard to neglect/cruelty to animals. The fact that she re-offended so readily goes to show that the law needs to tighten up and start handing out more severe punishments for first offences. An adult caution is evidently not worth the paper it is written on.
I have nothing against the RSPCA or ILPH but I think a (non-political) body needs to be created within the police force, therefore having the power of the law, to deal specifically with animal cruelty.
 

Now you see I think the following punishments are disproportionate (as in not severe enough) to the crime :
a sentence of 2 years imprisonment for rape, a conditional caution for stealing thousands and a fixed penalty ticket for being in possession of drugs...
 
If only there was the money for this - some forces are very proactive with equestrian and wildlife crime specialists - but even those officers do it alongside their every day role.

It doesn't feature on any political agenda, and these are the drivers for policy, therefore it will not happen
 
the law is bloody pants for animals and people if you ask me, its all wrong, white collar crime seems to hold greater sentences then murderers etc, makes me mad, there are some horrible people out there, am so glad those ponies got rescued, poor things, glad they are now safe
 
I agree wholeheartedly with your comments regarding the punishment and lack of deterrent.
While the 10 year ban may not be ideal it would be if it could be combined with an appropriate punishment that fitted the crime or misdemeanor.
In this case the horses were neglected, thin and louse ridden.
May I suggest that alongside the ten year ban a month's imprisonment would have sufficed.
But oh there is more and I am feeling extremely psd off and sadistic this morning.
How about for 2 weeks of that month's sentence she only be fed bread and water and the other 2 weeks normal prison food.
The cell should specially sealed and have added to it on a daily basis, mosquitos, a number of different biting lice and fleas.
I think the punishment might make her experience what her horses had to go through on a daily basis whilst under her care!

To get a prosecution you really need all your facts the moment there is scope for tales then the case falls. The problem is lots of these people know their rights. On the other side when a ban is issued there is nothing stopping the next of kin having them in their names so the whole process can start again...all very sad

Firstly, Hello - Im new here, and this is my first post.

Of course every animal lover's, (let alone our equestrian) guts are wrenched by only a 10 year ban. However, this is more lengthy than those previously possible, especially in Scotland - but I do think now that "its getting there" slowly but surely. 20 years ago these cases would never have been highlighted, main media wasn't interested, and the internet was in infancy. We have far more modes of culpability open to us now.

There are already national registers for those who have been proven to commit other abuse crimes. (I am in no way lessening, nor likening the current sex offenders registers to that of animal abuse - but I will stand by the structure).

If there are previous cases of abhorrent cruelty, abuse or neglect - why not create an online registry of such?
Its not so difficult - buyers, sellers, each proffering their own information could be coupled with an opportunity to check some RSPCA, SSPCA etc registers? Its only webspace. It can cost so little per year - especially if breeders, dealers, vendors etc all throw a few quid? (and no, I dont do web hosting).

We can only ever take people who come to buy our horses at face value. If they then turn out to be serial abusers, neglecters...we obviously feel the guilt, sadness and shame - that we got it wrong. Why not advocate something demonstrative to change it? Ultimately, we all breed these abused horses, ponies, donkeys & dogs - we should share the responsibility and knowledge of whom we sell to.

If one guy over 20years ago can raise billions by targeting the right media circles - surely these H&H forums are a great place to start looking for support?
