bank charges , can you claim back?

Just changed to Lloyds as am so sick an tired of HSBC charging me stupid bank charges or going over drawn by £10 or something silly like that.and its beyond a joke!
They charge me for being over drawn interest wise fair enough but then thay charge me bank charges for being over drawn beacuse half the time they put me there! I cheked today and I am bveing chargd £125!!! Every flippin month its between £80 - £120 odd in charges and its not that am hard up every month its beacuse they have charged me so much the month before that it carries over beacuse that £100 thye stole of me i actually need !
So annoyed, can I claim back yet?
 
dont you have a overdraft
theses are good i only have my on £50 but it saves me aload of charges im with hsbc
 
No they wont give me one, beacuse am always over drawn and the only reason I go over drawn is beacuse their bloody charges out me there,I cant win!
 
get onto the martins money tips site, there are letters there you can print off that you send to your bank re claiming back charges, sometimes if you ring the bank and query the charges they drop it back to a nominal fee although only do this once a year i think.
 
I sent them a letter this time last year and they had charged me £200 then! and I think now its almost £1000 they have charged me just in bank charges.
I would love to get that money back.
they told me back then they had every right to take them charges but I dunno if the law has changed for them yet
 
My OH is a manager at Barclays and he always says the customers that kick up a massive stink always get the money back! So dont take it lying down - make a huge fuss and see where that gets you.
 
Not sure you'll find Lloyds much better (though they do have an overdraft facility on current a/cs). They seem to get less customer friendly every year. I only stay with them 'cos it's too much hassle to move (I have a business a/c, ISAs etc. with them).
 
oh dear Ill see how it goes with them, I have 2 current accounts one with Abby and another with LLoys.
Hsbc just take the biscuit though.
All i want to do is to get my finances straight beacuse I do not like having that minus against my account and they wont help me do that and to make matters worse I cannot close my Hsbc account ultill I have paid it all off which means untill I do that theyll keep adding charges! U cant win
 
I claimed £2,000 back from Abbey a couple of years back, you can claim up to 5 years of charges. I printed off all the forms from the Money Expert website, it went as far as me taking Abbey to court on the via the internet/court web site, they backed down in the end and paid up

I think there is a test case going through at the moment as to wether charges are legal, if not they will have to pay out a fortune!
 
First Direct give an automatic overdraft of £250 when you open an account and their charges are pretty low if you stick within the o/draft. They are part of the HSBC group, but are a different company.
 
I have just completed the claim form on the link ISCHA gave me, theyre going to send me a pack in the post and they say no win no fee, so if u win how much do they take?
 
Sorry, this is going to be a long one (please bear with me while I vent my spleen)....

Don't whatever you do change to Nat West. In my experience they are appalling.

I've been in a similar situation with Nat West since February. I get paid by cheque, which I receive on the first of every month. As there's not a bank branch within easy reach of where I work, I always send the cheque by 1st class post to get there the next day.

I did this in February, but do you remember the severe snow we had in early February? Well, it meant that the local sorting office was closed, and my cheque didn't get to the bank until the 4th of the month. I had several direct debits set up for the 7th of the month and because Nat West state that it takes up to 5 (yes 5!) working days to clear a cheque, they very kindly bounced 5 direct debits, charging me £38 for each one (£190). I'm not aware that other banks take 5 working days to clear a cheque??? I always thought it was three days - and of course the money was visible on my statement to prove that I could pay the DDs - but just not cleared.

Now I'm not scared to admit it, but my bank account always runs very close to the limit, we don't have spare cash for luxuries etc. so that £190 had a knock on effect the next month, and because of this I've had more charges from Nat West each month since. The total charges so far this year is almost £600.

I have written numerous letters to Nat West right from the beginning, I've spoken to the Bank Manager more than once (Bank Managers by the way - who I'd previously thought held a position of some authority - are actually nothing more than a glorified clerk and have no authority to make decisions whatsoever) and Nat West will not back down. I was even able on one occasion to PROVE that something that the Bank Manager did had broken the bank's customer code of conduct (which I quoted to him directly from their booklet), yet their written response was still that they could see no error in their ways.

And whilst the fight goes on, I continue to get further into debt, whilst at the same time unhappily making a major contribution to the £750,000.00 pension fund of the Chairman of the RBS.
 
I know what you mean Faro, years ago now I think I was about 17/18 I opened an account with Natwest beacuse of reasons I cannot remember I had a debit account with a cheque book for all my livery and horsey bills. I gave my work my new bank details but this must have been to late for the money to go to my new account which I wasnt aware off so when I was writting chques for my new account for bills and they bounced I think there were 4 in total for vets fees,livery,feed bills and that sort of thing (only things I ever wrote chequyes for) they charged me I explained to them what had happened yet the still kept adding more and more charges to my account untill it got to about £700 odd in 3 months, I couldnt winn the more i paid of they added back as more charges. I eneded up paying then £1100 in charges and I cannot remember my acocunt detials to claim them back, that money would get me a new saddle lol
 
I left HSBC for the very same reason - They took me over my overdraft limiit (I went over by 10p or something and back into my overdraft on the same day)but they had charged me and kept charging me until I was over 1000 overdrawn and they threatened me with court.
Im now with Natwest and (so far - fingers crossed!!) they have been really good - dispite me sailing very close to the wind on numerus occasions with my OD!

I argued that i bought something on my debit card which put me over drawn by about £10 they then charged me because i was over drawn, my argument was that they should have declined the payment because a debit card means you are meant to have the funds in the account to clear it and i obviously didn’t. I was told that they authorized it as a good will gesture but then charged me because i went over drawn. I said i didn’t ask them to put me overdrawn therefore they had no right to make that decision for me. I won eventually and they refunded me the charges but i had to really fight for it.

Stupid banks, I wouldn’t but as tax payers we own most of them anyway.
 
A couple of years ago i claimed back my bank charges by following Matin Lewis's instructions.
I got back roughly £3500 and bought my beloved 4x4, which I am lucky enough to own outright as it was bought with cash.

My advice is just to do EXACTLY what Martin Lewis says on his website, use all the template letters, follow the timescales he advises etc etc
 
I am in the same position with HSBC- because of a mistake the equine cremation guy made ( i mean come on how crap does it need to be!!!!!!) i went overdrawn and didnt realise- i had budgeted the £75 out not the £175 he accidently took. HSBC are a pain for charges numerous £25 charges this month for less than £10 overdrawn each time as i see im OD pay in money then its OD again- I am v peeved with them- however we had a nightmare with natwest and have 1 mate who loves barclays but OH dad is incensed with them

Cant win either way!!! However am going to be proactive and get letters to send to HSBC anyways xxx
 
Im another against HSBC. They are a joke for taking loads of money off you for going slightly over your balance.
I did reclaim my charges off them about 5 years ago and got about £500 back but hey they are still taking money off me! I sent them another letter to advise them again of the unfair bank charges but they were going through the courts against their unfair charges. As far as I know they are still in the courts, think thats all banks not just HSBC so are not paying out at the moment. They are trying to justify their charges.
Im now with Barclays and slowly paying my HSBC account back but find Barclays much better than HSBC.
 
Lloyds aren't brill but better than most- they will 'as a gesture of goodwill' refund a particular set of charges once every 12 months- I learnt this while at uni and very silly with money. Now as far as I am aware- if the bank offers to pay back some of the bank charges- if you accept their offer you can never reclaim again/claim the remaining charges. However, if the test case works in the favour of the customer those who have yet to claim will have the right to claim back all the charges within the last 5 (??) years. So be careful how much you accept from them. They may try to fob you off with a small 5 of the charges that they have actually taken from you. If the test case works against the customer them you will be lucky with what ever you claim back- just dont let them fob you off!

[/ QUOTE ] I belive all the banks are the same just roges and greedy scum they make a fortune, then the moment there is a slight glich they run crying to the goverment, now they are making more than ever by not passing on lower interest to borowers, and kicking people who are in a little trouble and milking them with charges when they dont play by the banks rules because a check hasnt cleared or they went slighly over drawn.. I am not going to borrow anything if posible.. im selling my expensive car thats on Hp paying it off and buying a cheep one for cash and paying down other loans Im sure its better to live simply for a year or two build up a bit of cash and only spend what I have not what I hope I will have

I bank with Nationwide. On numerous occasions I've gone slightly over my overdraft (cheques not clearing in time to cover direct debits and similar reasons). On each occasion I've written a polite letter and been given a full refund

Its always worth a letter, and if they're awkward about it kick up a fuss and don't stop till you get your money back! And change banks afterward as well!
