But if she is claiming on social for a bad back then dob her in to them, at least she might then loose her benefits

tell me about it! We had a memo telling us how to walk down the stairs properly!!! 'One step at a time, maintaining grip on hand rail at all times'. You basically need to do a risk assessment to breathe these days.
 
Merlotmonster thanks very much for the offer I will certainly take you up on it if this goes further. The only witness I know off is her charming boyfriend who came to the door to when my husband was at work informing us of her bad back whilst she sat in the car having just been to take care of her horse. Unbelievable really as we only passed her in the car out on the horse at the weekend.
I had thought about the incident with the stick, the first time i saw her do it may not have been the first time it happened. Maybe Lucia was expecting something like that to happen when she kicked out. I'm trying to justify her actions as it is so out of character for her. They were the only livery until we arrived and were never happy at our prescence there and have been unkind to my daughter and ponies from the first day. My daughter had stopped going round when they were about so the stick incident was the final straw. We took it for so long as the field is next door to our house, unfortunately the horses are now 15 miles away at my parents.
My parents have spoken to the insurance company and they personally think we don't have too much to worry about, the blacksmith loves doing our horses and can vouch for their excellent natures so I'm hoping this is all the desperate actions of bitter twisted people.
It just makes me so cross, my daughter is absolutely dedicated to her 2 Lucia, the TBxCon 5yrs and Dilly a connemara 18yrs, (both of them every parents dream) and was always the first one there in morning poo picking at 6.30am. Why would other horse lovers want to discourage her. She competes most weekends and always does well and has a bedroom for a rosettes and then you get numb skulls like them causing trouble and upsetting her. I think you can tell this has really spoilt our day!! Anyway rant over!!I will look into insurance for them, but I had thought with Dillys age and Lucia having and old scar on her hindleg the premiums would be enormous. Thanks again for all the advice, and being able to get this off my chest has been great. Its my first time on here, I found it through Google when looking for advice and I shall certainly keep coming back.
 
There are plenty of nasty people out there unfortunately, who just want to make money out of every opportunity. Its a really nasty thing to happen to you and lets hope she is all mouth and no action. On the face of it she will have a very difficult time in proving this and once she realises the hoops she will need to go though to prove even the causation aspect, she may give up. I hope a good solicitor will tell her not to bother.

Try not to worry about it. If you get a formal letter let me know and I will draft you a response. I have scared off many a chancer so dont worry!
 
Its always advisable to have at least just the 3rd party insurance in case of things like this.

With that Mirvehdy ruling (or however you spell it) if the horses got out and caused an accident - you would be sued.

Basic 3rd party isn't that expensive. If you are going to look into insurance proper, ask for recommendations as certain ones, Petplan, NFU and I think SEIB etc are worth a try, some are notoriously terrible!

I know at the last big livery yard I was at, 3rd party insurance was compulsory but as stated, being a member of the BHS or Pony Club is an alternative and possibly cheaper.
 
Hopefully its all mouth. my friend couldn't get a solicitor to take her comp claim against me(my horse literally stood on her head and left permenant damage,mild but permenant, it was a run up with vet gone wrong)As soon as she mention the word horse they said no esp those no win no fee ones.Scottish law so is different I think not sure how much tho.
She did deserve something as spent a year in intesive/rehab units
folk taking the p like that spoil it for genuine cases I think.

i agree that if the woman is claiming benefits for a bad back then dob her in, can be done anomously, just google DSS. They will more than likely send someone out to follow her and watch what she does. Im not sure on the laws about taking photos of people but i'd definately take a few if you see her out riding.
As for the stick thing,like you said she may have done this before and provoked lucia into kicking her, tell your insurance/solicitor you have seen this woman chasing your horses with a stick.
 
I'd like to know how she's going to prove it was a kick from your horse that hurt her back. And not her mucking out. Or pushing a wheelbarrow. Or riding a horse. I'm sure years of that kinda thing have caused a bit of wear and tear on her spine.......

Hands up all horsey folk who DONT have a sore back from time to time?

No-one? Thought not. She's a chancer.
 
The DSS has an anonymous helpline you can ring, they don't ask any question about you but do like to know name & address of person you are shopping! If you think they are earning anything then you can fill in a form on the Inland Revenue site as well.

They'd hired someone to come in and show us!!

I mean - how bl**dy ridiculous. You grab the ladder, open it, push down the top step so it clicks into place, make sure it's on a level surface and then up you go.

The worst injury you're going to suffer from that is banging your head on the suspended ceiling after you've climbed up one rung!

I wouldn't have been surprised if they'd made us wear hard hats, goggles and a harness too!!

The fact of the matter is that we don't have to stand on a ladder to put the decs up, we can reach the ceiling from our own feet

Oh - our company pays for 'engineers' to come round and change all our clocks. We don't have permission to do that either!!!
