Lovely looking horse on horsemart at the moment, HM949JH38. Being sold through a dealer, the owner they have given the number for is one of 2 girls I bought a horse from , they are well known in this area not to buy from, and I believe they are being taken to court over other horse sales.

Exactly! Since I have bought my horse from them, many people have told me on here that they are well known for bad sales, and I would have been advised not to go near!! Just trying to return the favour.

The dealer is fine as far as I know, I have had no dealings with him, just the girl that I believe is his girlfriend. She used to work with another girl in kent, but again, i am lead to believe that partnership has disolved, so now she is selling horses through someone else.

I am not sure if i am being naive but you have not mentioned that you have not had any problems with your horse? Thus i am abit confused as to why you are black listing her bearing in mind it could be seen as slander?

I have had many problems with my horse, which is an ongoing matter. As I say, when i have put different posts on her about my horse, many people have said they are well known, and would have advised not to buy. Maybe I am wrong in trying to do the same....Sorry.

I didn't say you were wrong to say it..but if you don't state that you have had any problems in the OP then it comes accross differently to if it was evidenced!

So I'm totally confused about the reasons behind this post then........

I just dont want to see anyone else buy unwittingly from this girl and be in the position I am in now. Trying to be helpful.

if the person selling this horse on behalf of the owner is a dealer, then you would be protected under the sale of goods act. so you have as much legal rights as going in to a shop and buying something. the sale of goods act states clearly, that the object/animal has to be fit for the purpose it was purchased for. so...in the event that it turns out to be not fit for purpose, you have a legal right for your money back, plus any incurred costs....just thought i would enlighten any of you that might not know this....x

If the dealers girlfirend is the 1 I think it is then there is a big court case going on at min and someone on another forum is trying to get info about it all as bought a horse from them with all kinds of problems! Can you pm girlfriends name? Did you post on horsemart forum about her?

Not running you down at all, many do this on here, however, there are a lot of 'ifs' and 'buts'. You really should have FACTS when posting something like this.

OP has pm'd me and is the people I thought it was - there definitely IS a big court case going on at the moment so anyone posting with info please be careful not to post anything that could be detrimental to the case and definitely a case of buyer beware with this dealer - know of several ppl who bought from them and having to take legal action or been left with problem horse :-( If anyone does have any dealings with this dealer there is a lady on horsemart forum looking for help - has her own legal case against this dealer going on at min too!

OOh, I do love to see that written. How many times have I seen it on this forum, and wondered if the person using the quote has ever had a real problem, bought a horse, lost money and seen the horse die. Or if they just churn the phrase out, like some kind of lucky mantra, certain in the knowledge that it must be right because someone else trotted out the thing about buying from a dealer and getting your money back. It doesn't always work like that, and you should certainly not go into a purchase thinking that, when things do go wrong, you will find it easy to return a horse and get your money back... like handing in a defective toaster!.Especially when the person you bought from suddenly becomes unavailable. It also has big implications on liability when you buy a horse through an agent, whether they be a dealer or private seller. ( google that too!)

This forum offers useful and helpful advice and surely warning prospective buyers that there have been problems with a seller in the past is useful and helpful. Anyone on this forum can google the phone number, read prevous posts and see that the person has indeed been taken to court in the past. It is public knowledge and not slander. There are people on this forum who are in the process of taking the person to court.

Personally, I wish I had known of this forum before I bought from one of the two girls mentioned, and used their recommended vet for the vetting.

If I was an honest dealer, I would be very careful about associating myself with someone, shall we say, with a history.

Its so sad that they keep getting away with this (polite version of what id like to say)!!

I feel sorry for the people who have been ripped off and the horses that have suffered while having to pass for the horse they claim they are and what happens when the buyer finds out they arent all they should have been :-(

the law may state the sale of goods act buying from a dealer if things go wrong..you may even win when you take them to court...does'nt mean anything when it comes to getting any payments set out by the courts...we are still waiting 5yrs later even with the court rulings all in our favour...these dealers just shut up shop and open weeks later under different names...
all i can say that hopefully with this ad it claims to have bsja winnings and hunted etc so if it was me looking there lots of records you can pull up and talk to local hunt etc...
its not to say there are'nt lots of good dealers out there and a great job they do...
what i do find intresting in this case is ...is the person counted as a "dealer", as when selling someone elses horses on there behalf, it would normally be said they were acting as an "agent" this would mean by law it is then counted as a private sale and the only come back if there was a problem would be with the "owner" then its back to buyer beware!!

Can't say too much for obvious reasons on open forum but this horse has previously been advertised under another name/breed - def same horse but with a different story i.e. dealer had for some time good home paramount. PM me if interested in all the details?
