Right, and breath...

(after my previous posts re theft etc)

I've finally completed the online forms for the Small Claims Court with regards to trying to get something back from the ba*tard saddler who has run off with a saddle, left a horse with a bad back, left me with a saddle I can't use, left a pony with an open sore, taken heaps of money for work he hasn't done, blah blah the list goes on.

I'm not sure what happens next or how long this stuff takes, but feel sort of good because I've done something positive, and sort of worried in case he just chooses to ignore it and then what?

Oh well, fingers crossed please that he finally sees the light and for once something good comes my way.

(I did contact Trading Standards and Consumer Direct, but didn't hear anything back from them...)
 
I have no idea re the process but good for you for making a stand. Hope that you are successful with your claim. There should be some notes on the internet somewhere about the process if they choose not to respond.

. My OH is on his way through SCC with a non-paying customer so I have a bit of an idea how it works (as I have to do his paperwork!!)
After you have filed your claim they (the bad guys) have a limited time to respond (I think 28 days from date you filed on) giving their side of the story. If he doesnt respond I think a judge can take it straight to a hearing, but if he does and if both sides agree to you can then proceed to telephone mediation to try and reach a compromise (you both speak individually to a mediator, its not a conference call freeforall as was my first impression!

If nothing can be resolved through mediation you inform the court that you wish to proceed with a hearing, you then get a court date and have to pay approx another £100 which you can claim from the baddies if you win. The hearing date can be 3 months or so after mediation etc. You must make sure you have signed statements and pictures etc. from any witnesses you want to use, you will have to send a copy of all of your evidence to the bad guy at least a fortnight before your hearing. He will have to do the same. If you miss any dates or deadlines your case can get thrown out of court. Maybe sounds a bit complicated or long winded but its quite straight forward really - they mark all important deadlines etc very clearly on paperwork. If there is anything you're not sure of you should contact your local court (the phone no will be with the address in v small print in the footer of tthe letter you will receive shortly confirming your application.
