Buying a Horse - Deposit

Can anyone answer the following;

I recently paid a hefty deposit to a dealer on a horse "refundable subject to passing a 5 stage vetting" sadly the horse failed the vetting so I requested my deposit back.

I was told by the person I handed over the cheque to that they don't bother cashing them until after the vetting.

After chasing them for the return of my deposit again a week later I was then told it would take up to 29 days to return my deposit as legally they could do that???

Can they??

No, they must return the cheque straight away. Ring trading standards - sorry don't have phone number at the moment but can let you know later.

Sounds like its just as well the horse failed as they don't sound very reputable.
 
They can request a time scale as can any company for returning cheques but you should have been warned before hand.... ring trading standards though in case these are dodgy dealers!

I think you may still be able to call it back.

Recently a lady paid for my pony with a cheque. I paid in the chq on tuesday, she said the money went out of her account on the Friday but was not cleared into my account until the following Tuesday.

I think you should ring your bank right away and get this sorted out - otherwise go to trading standards.

Did you get a written receipt for your cheque stating that it would be returned if the horse failed the vetting?
 
Thye should have put this on a written reciept. If they have and they have signed it, also signed by you then they MUST return the money. I'm actually suprised they cashed the cheque before pony was vetted, seems a little thoughtless!
