Can anyone give me advice re livery and notice etc

I need to ask advice, I have 2 horses on a yard and I am moving them so I gave YO notice as per my contract and paid in full the notice amount required as set out in the contract.

I also had 2 other ponies which I sold in May and paid their livery in full but no notice period was agreed and no contract was put in place for these 2 ponies. The yard owner now wants notice money as i'm leaving (he hasn't told me how much yet but I think it will be 3 months like my other horses) I am moving next week and I want to know where I stand legally with the notice he says is due, and if he can stop me moving my other horses who's contractual notice has been paid in full. Help its worrying me sick as I cant afford to pay anymore money :-(
 
It is up to the yo to provide evidence that you have breached your contact agreement. As you have no contract for the ponies and they have been gone since May, then i should imagine he would be told by any solicitor that he hasn't the proverbial leg to stand on. Do you have a receipt for the livery you paid for them? As for the horses you are going to move, if you have paid the livery up to date and given the necessary written notice required then he cannot stop you from removing them from his land. If he gets arsey and threatens to phone the police, let him, they will not get involved as it is not a criminal case, and they will say if he wants to persue it he is to go through the civil courts. Just ignore him and get your horses moved.
 
If there is written contract in place, the rule of thumb used for how much notice is how often you pay livery, so if you pay monthly a month's notice etc.

No one can stop you moving your horses and they are completely separate cases which he can't mix.

However if you haven't given adequate notice the yard owner can pursue what he thinks is owed and it's very easy to do through the small claims court.
 
The notice for my horses im moving is 3 months, so he wants 3 months for the horses sold, they were only foals which were on grass for a month before I moved.

This. If he wanted notice paid for the foals, he should have drawn up a contract for you to sign and he should have been chasing you for the money by now.

He's just trying one on. Ignore, say no, be polite but don't budge. It's up to him to take it further and he won't get anywhere!

3 months notice is crazy! I've never known anyone to ask for more than a month. Even residential lettings are usually only a month. Heck I only have to give 8 weeks for my job...

If he was that bothered about the two you sold, he should have said some thing in May.

Why is the YO pursuing you for the ponies' livery and notice money? If you sold them in May, they are the resonsibility of their current owner and nothing to do with you.
This person is bullying you, by the sound of it. Have you got anyone to support you through this? Good luck and don't let the barsteward grind you down!
 
How old were the foals - if under 6months and with their dams they cannot be charged for.
Once you knew they were sold, how was it before they left. If there is no contract in place for the ponies then YO can go play with the traffic.

For your other horses if you have abided by your contract, 3 months notice and paid to date then you are covered and YO can't get snotty and demand more.

Do you give your notice in writing or verbally? If verbally maybe YO has forgotten that you have given the correct amount of notice.

I think a lot more places/people want longer notices! same with deposits - up here seems to be about 2 months dep they want up front now for flats. And my OH has to give 3 months notice, although is colleague just handed in notice and said he was leaving in one month, no negotiaton.

I have paid the livery for the 2 under contract in full and gave the 3 months notice required in writing. (By email)

I have said I will pay the £325 owing for the ones sold in May before I leave
 
They were 9 months on purchase and 1 year on selling. I sent a text on the 29th of May telling her they had been sold and were being picked up in the next few days.
 
If this ended up in court you would find that the 3 months notice period would be reduced to a more reasonable one month period.

Why? You're paying for a three month notice period that was never agreed, no contract was in existence, and she made up a rule after the event. By caving in and submitting to her demands, you're basically saying its fine to rip you off. If she gets away with acting like this now, she will try it on with the next poor person, and the person after that, and the person after that...
