how does that work for loan horses? Is it because the loan agreement has a clause in it? Because when you loan a horse providing it says it can be hunted then is it not the same thing? (not trying to be clever, genuinely asking!)

The key is in the 'let out for hire or reward'. A loan horse would normally not be 'for hire' - but should contain clauses that cover:

1. If there's anything you DON'T want done with it
2. That the loaner takes full responsibility for 3rd party liability etc.

(as well as all the normal safeguards.)

what about a share or part loan? You're paying a sum towards the horse's keep but if your allowed to hunt it then is it the same thing but in a different context? I have heard of people hireing there horses out to hunt, although they have been done through the hunt themselves as hirelings- Would they then have a clause that states any injuries or accidents are not claimable from the hunt?

I am about to full loan my 17hh TB and I can put in a clause for no hunting, I took the agreement of TDS saddlery it states in there - not to be hired out, which I have kept in the copy I typed up. The person loaning him has asked me to hunt him first as he was a rescue last year and an ex-eventer, but has a buck with other horses charging around in front.
I also have another horse stabled in same yard so can keep an eye on him.
I think to hire out your horse would be easy if he was insured correctly, but I would not take the risk, some other people have no regards for hirelings, unless like me who hires to hunt - in other areas - I take care of the horse as if it were my own, I know many other people who are especially careful with their hirelings too.

Most hireling yards only let you out for 1/2 a day unless the day has been quiet then let you stay out for an extra hour.
