Hi

I need some advice, I hope someone can help!

I brought a horse about 6 months ago, and the previous owner is still being quite interfering with what I do with him. She sold him to me as she knew I would look after him, as he was not suited to her requirements.
When I say interfering, she is questioning things like why I am clipping him when he is not in work (even tho he is very woolly and sweats like a gooden in his stable at night).

I know I am being quite vague but if this turns into an argument can she legally just turn up and take him from me? (as this has been threatened before!)
I have his passport and this was exchanged once I paid her in full for the horse. I have receipts of vet treatment, back specialists etc but no receipt of sale.

So how does this stand legally!

Block her number & tell her you will report her for harassment if she continues.. Nothing you do with the horse is any of the old owners business.

Do you have anything in writing to state that he is yours, even an email or text? If not, do you have bank records to show transfer of money to her?
 
Do you have receipt that show transfer of ownership, have you also got the passport in your name now?
Proof of payment for the horse also.

If yes to all the above perhaps a politely worded letter with a picture of horse in a Christmas card to old owner, with a thanks and you will send updates as and when.

As much as previous owner couldn't or shouldn't, just be careful, we have heard of horses being stolen etc.
Do you know where they live etc, just in case?

That is unlikely to happen, but just be prepared.
Humor old owner, explain why you are doing, things, after all they arnt there every day caring for horse so how do they know what is best?
Just nod, agree, then do your own thing!
 
The Passport is now in my name, which I know is not proof of ownership, but then why would she give me the passport if I had not paid her.....I will have to check my bank statements as I paid cash and see if i took that amount out, but I cant remember as may have taken different amount from different accounts...
 
Humor her untill you can get a reciept. Once you have the reciept tell her to back off and if she threatens to take him, tell her that it owuld be theft as she sold him to you.

If she asks why you need a reciept tell her your bank have noticed some fraudulent activity and have stopped all transactions untill you can prove the large withdrawl (for the amount of the horse, she does not need to know if it came from one account or many) was made by yourself.

Once you've bought something, it's yours. If you didnt get a receipt then that's a shame but I'm guessing there are witnesses to say you've bought him, and the passport is now in your name?

I just wouldn't answer her calls anymore, and send her a letter (or email, as there's a better record) advising that you won't be discussing the horse any further as you feel she's being intimidating.

Then just stop all contact.

The fact that you're asking this though does make me wonder if there's more to it...?
 
Hmmm no receipt of sale she could be a pain and say that she didn't sell him to you. Technically she could argue that the passport has to stay with the horse which is why you have it.

Sorry to be doom and gloom but just being realistic.

So trying to be positive here.
Do you have any proof that he is yours?
Do you have a family witness to you paying the money to her?
Do you have anything that states the horse is owned by you?

A valid point that receipt of sale is really needed people!

Did she not have to sign a transfer of ownership form for you to update his passport?

ahhh just looked at the passport and I kept a copy of the signed Certificate of Transfer of Ownership ...... which has her signature on so does that mean legally he is mine?

Yeap horse is all yours! Now relax and ignore her interfering / block / unfriend her on social networking sites so she doesn't know your business.

I would say that's is proof enough. I would tell her that whilst you understand her concern, would she kindly **** off and leave you to it.

I dont like arguements and dont want to be in a position where I feel she is over stepping the mark but dont want to carry on feeling I have to justify everything I do or everything done is going to be judged and then having the 'well I will just come and take him back then' comments . :(

There you go nice and tidy proof.

If you don't want to make an argument out of it, then perhaps a friendly chat and that you will let her know how things are going in the spring.
 
He is your horse. He is no longer any of her business. End of.

Tell her just as you won't comment on how she cares for her horses, you don't care for her commenting on how you keep yours. Any threats of taking him back and I would actually laugh in her face I think!

lol nope not on our yard! .... keeps up to date with facebook..... and through mutal acquaintances ..... Its quite upsetting as she knows (and anyone who knows me) knows I love that horse with all my heart and treasure him as he is my dream come true.

I'd start to cut contact, stop replying, take longer to reply etc. Enjoy your horse! He's all yours! ;)

If you fully own him, have paid in full then no she can't turn up and take him, that would be theft. Tell her to *insert nasty word* off. Tell her you've been more than patient, but that this is your horse, she sold it and if she wanted to control how it was kept she shouldn't have sold it. You didn't buy her as part of the deal!
 
lol my horse will never forgive me if I dye his mane pink or buy him a onesie !

Thank you all for your comments...... I hope others will see the mistake I made by not getting a receipt once the cash was handed over....as that would have saved me fretting over losing my horse.
As it stands as I have the change of ownership form (a photocopy of the previous owners signature) and the new form now has my name as owner.....I know he is not going nowhere.
I am very happy and relieved :)

BLIMEY ! What a nasty cow ! Sadly i don't think this sort of behaviour is rare in the horsey world.

I go with the onesy, one of those fruity rugs, dreadlocks, and blocking contact entirely. If she persists, speak to CAB about getting a solicitors letter drawn up. She is harrassing you.
