Can I chuck livery out??

I have a livery who has given me 2 weeks notice and taken her horse however she has left a stable full of buckets, rugs, stable mats and oddments. She has paid an agreed 2 weeks notice so I am allowing her to use the stable for that period before i move another horse in.
Question: Can I tell her to collect her stuff and move another paying livery in and refuse to refund her money?
 
You have to refund her that's not fair if you don't she has paid for the stable she can do what she likes with it.
You can ask her to move her stuff out though but you have to refund her before getting in a new livery.
 
I would say no - she's paid the money for 2 weeks notice, she's entitled to have the stable for 2 weeks - if the horse was still here you wouldn't be able to let the stable.
what did it say in the contract?
 
Of course you can't! That sounds like just bad feeling on your part. She has paid upfront so the least you can do is allow her the use of the stable.
 
I have just read another post by you where you say you always let liveries use the stables even if for storage if they have paid
 
It is not so much whether you can or not but what she can do about it!

Obviously yes you can. Argueably you should provied secure storage for her belongings for the 2 weeks - you can't just dump them outside, let them get damaged or nicked. If you move her stuff before the 2 weeks are up then do have someone as a witness otherwise you risk being accused of stealing something valuable.

Is it moral to do it? That is your decision entirely!

I would suggest contacting her and asking her to move her gear herself by a set date - give her a bit of time. If she doesn't, then you can move it yourself. As long as you are careful not to cuase damage or loss there is no restitution in law. But if you do, even by negligence, cause damage or loss then she could pursue you through the small claims court for recompense.

If they asked to bring their horse back until the end of the agreed notice period, is that unreasonable?
 
I don't see the prob with her bringing the horse back until the end of the notice period. When I have given (and paid) notice when I want to leave a yard I totally expect to keep my horse there until the end of the notice period. The notice period is there to give you the benefit of advance warning so you might have the opportunity to line up another livery ready to move in, not to move one in right away!

Please note this is hypothetical (see yesterdays post if in doubt!) I would never chuck my liveries off or not refund them just frustrated with YO that would and seeking opinions X
 
I think on a busy yard with a waiting list it would not be unfair to move a new livery in provided you offered secure storage for her things for the 2 weeks and a partial refund as the storage should be cheaper than the stable.
 
I don;t know why you (or other YO) would? Except of course to double the money! I have just moved my two horses. I gave a months notice, and moved them three weeks before the end of the notice, for my convenience. I kept YO informed all along, and he had another livery lined up to take one space two weeks before notice ran out so he refunded me two weeks livery for one stable.

The second stable I kept on for the two weeks as I wanted the storage. Had the YO needed the stable he would have asked me, and if I were able to move my stuff I would have done so and he would refund me.

Are you the livery who has paid and moved her horses but left eqpt behind, having paid in advance? Those stables are paid for and therefore 'unavailable for alternative use' until the paid notice is up.

This smacks of 'only getting half the story'.

dragonslayer, you seem to post stuff like ^^ on a very regular basis.. do you not enjoy the forum ? Doesn't look like it from here.

Actually, I do enjoy the forum, there are lots of bits of information I like to read.

However, I'm just amazed that some people can turn a simple question into 'Something Slightly More Sinister'.... And if they are allowed to do that, I'll carry on posting my amazement! :D
 
Actually, I was trying to get an 'angle' on the situation - and TBF the Op has posted from both sides of the argument, I feel. No conspiracy theories imagined or otherwise here

haha No Just thought it was an attention grabbing title! :0) Its a hypothetical question!
Just wondered how the yard owner and livery are protected in this sort of situation and whether if you are paying for something you are entitled to it? It doesn't seem black and white ie 'if you are paying for a stable you may use it', it seems you may not be allowed to use it if the YO has another livery to move in (collecting double the rent). I would have thought it would be kind (not sure what is correct legally which really is the point of this post) gesture to refund in this situation, is it not just greed holding onto original liveries rent while taking it from a new livery?
 
It might have been easier for the rest of us had you posted this in the first place!

IMO the livery has use of the stable until the end of the notice period unless another arrangement is made. You wouldnt have any rights to move the liveries belongings until after the notice period was up and then you would need to advise the livery in writing before doing so.
