Can I claim compensation?

Was driving to hunting on Sat going through our nextdoor village and I heard a big bang as I was passing another car. Couldn't see anything so went and parked and found I had a completely shredded front left trailer tyre and the rim is all banged out of shape too.

On the way home after changing tyre, we found the culprit - a rather large pothole right at the edge of the road by the verge. I was on the road as we drove over the pothole.

Can I claim a new tyre and rim from the council? Probably sounds petty but I was pretty p*ssed off as they aren't cheap.
 
Hi yes years ago my car wheel sustained damage in a pothole and I immediately contacted the local County highways department and reported the pothole and damage. I had to send in a copy of the bill for my new wheel and tyre and they compensated me.
It's the road reinstatement department that are responsible for ensuring that the highways are safe and pothole free.
 
According to my brother who has just received his compensation cheque from our council, the key is whether the council knew about the pothole in question before your accident, and had done nothing about it. Eg, if they had been notified of the pothole and done nothing = you can claim, but if they didn't know it was there = you can't claim (well you can try but it may not work!).

Now I wouldn't necessarily take his word as law, and it did take nearly a year for him to get his cheque, with solicitor's help, but I'd say its definitely worth a go, with pictures of hole, and assessment of your wheel damage included.

I believe this is true. My husband's tyre & rim was completely damaged by a pothole and because no-one had reported the pothole to the council nothing could be done. However, if the pothole has been reported then the council have to repair it.
 
Yes you can! There was an article on our local radio station about this recently; this has happened to me in the past and I didn't realise you could claim if the damage was caused by a pothole.

Get a photo of the hole PDQ tho' coz otherwise it might get filled in (if you report damage and say you want compensation).

Also make sure you've got your garage's repair bill, plus keep receipts of e.g. alternative transport arrangements you might have had to make/towing in charges etc etc.
 
Iv tried but no luck.
My friend has been fighting now for 8 months and still no luck.

Pisses me right off when you pay your rd tax. The lanes I drive are awful and unfit for tractors let alone cars. But yet I still pay the same rd tax for bloody **** lanes, won't lower my tax though for sub standard work will they.
Makes me mad
 
Strange as this may sound, but your road tax does not fund highway repairs. That comes from (in part anyway) your council tax.
 
Yes you can, I did well over £800 worth of damage to my car last year an managed to reclaim most of it from the council. However I also took measurements along with photo's and the council had to have known about them as they had been there for months!
 
My hubby tried to claim in December, took photo's and had the garage bill. Apparantly someone had reported the pot-hole 4 days earlier and they were going to fix it. They said it's only if the pot-hole hasn't been reported then you can claim.
