I'm hoping this is the right area to post this in and that someone may be able to help. Basically I took on a pony as a companion in July of last year, about 2mths after being with me he started displaying nasty behaviour so I told the owner I wanted to return him and gave her a months notice as stated in the contract. She said she wasnt really in a position to take the pony back, however suggested a few things to try and he settled right down. I said I would see how things went over the winter and contact her if I still wanted to return him, she had also agreed to me trying to find him a new loan home. I last heard from her in October, unfortunately due to no fault of the ponies I now need him to be rehomed or returned, however I cannot get hold of his owner at all, I have tried text, whatsapp and calling her mobile, also leaving a voicemail. The contract is actually in her daughters name although she signed it and I have an address for her daughter but no surnames for either of them. I have spoken to the BHS legal advice line but due to having no surnames they cannot confirm if there is any conflict of interest so cant assist with what I should do. I have contacted world horse welfare and they have suggested contacting the microchip company and the passport company so I plan on doing that as well as sending the daughter a letter to the address I have to see if anything may have happened to her mother. If all this fails I really dont know what else to try, has anyone ever encountered this situation and come up with a solution as I am fast running out of ideas. Thank you for reading.

Somewhat surprised you thought to get a contract signed but didn't get surnames?? Never mind though too late now. Does your contract cover this eventuality? I'm pretty sure the standard BHS one does ie it permits you to sell the pony etc. In practice I would be sending recorded delivery letters to the relevant addresses serving the relevant notice. If the pony is not taken back at the end of the notice period then I would consider it abandoned and be serving abandonment notices and taking ownership via that process. Then unfortunately you have to decide what to do with the pony. The less formal option would to deliver the pony back where it came from and leave it if that is possible?

Write to the address (recorded delivery) and txt any numbers you have etc saying that you have been trying to contact them since X date and that you are no longer in a position to care for the horse. State that if you do not hear from them within 7 days you will issue an abandonment notice and the horse will be sold at the end.
