Comeback on a dealer? Is it fair?

I've had my new horse for 8 weeks now and she's been fab. Except this week she has exploded in the canter. I've had the chiropractor out as she had a couple of lumps on her back and she has referred her to a vet next week but I know she is highly suspicious she has a kissing spine.

Now I bought her as I lost my boy with a broken leg in the summer and my other horse who is only 7 has arthiritis so as you can imagine I am panicking at the worst.

I do have her insured for loss of use if need be but do you guys think I have any recourse on the dealer I bought her from - although I am sure he knew nothing of this condition.

By the way I did have her 5 stage vetted and so did the dealer 3 weeks before!
 
Wouldn't have thought so especially as you had him vetted

You have up to 6 months to return a horse to a dealer if the horse is significantly not as described. You can take them to court and you will win. Wait to see what the vet says, then take legal advice straight away.
 
Thats what I thought & also that she was trying me out but doesn't explain that she was extremely sore on part of her spine.

She was sore along part of her spine when I first got her but it is much worse now. She also has put no weight on and no condition or muscle.

Just realised this is in Competition and Not Stable or NL - whoops !
 
I'm hoping its the saddle but the chiro thought not as the pain wasn't in the right place - booked in for vets next Wednesday with both of my horses now !
 
Why don't you get your saddler out to check the saddle?

I can see why you're expecting the worst, but the most likely scenario is she's just being naughty or the saddle's rubbing, or she just did something in the field.

Re. weight gain, it could just be she's stressed having moved to a new environment.
 
really you dont have a come back on the dealer she was vetted and passed and shes been perfect, you have got to remember a vetting is like an MOT its just the horse at that moment in time
