Says in CAPS at start of advert that it's a private sale but if you Google the mobile number on the advert they've this number of horses for sale ????? :confused:

So I wondered, can a dealer (if selling their own personal horse) operate as a private seller for that particular sale? And not be held under 'dealer' terms of sale??? Just curious since reading this advert.
 
As soon as I saw the photo I knew that was Kent Horse Producers, all their photos are taken in the same place! :-)
I've heard good things about them so can't see why they'd be trying to do anything dodgy, maybe it is one of their own personal horses if you know what I mean.

Yes that what I was wondering about. How a dealer could legally differentiate between a horse bought, brought on and then sold (as part of the business) and another horse bought, brought on and used personally and then sold on 'privately' as a private sale. How could they prove it and would it stick in court?

Definitely not suggesting this dealer is dodgy, not at all, but you can see how it COULD be used by some less than reputable individuals to their own advatange and if someone did buy a dodgy horse from a dealer as a 'private sale' would they have any legal come back. Just wondering really, as it's already such a mine field buying horses.

I know plenty of people who have had issues with them and wouldn't recommend them with a very long bargepole! It has absolutely NOTHING to do with it being their personal horses or not, it is purely and simply down to the number of horses sold and how they make their income.

OP - a lot of dodgy dealers try and pretend to be private sellers, as dealers are bound by legislation, private sellers it is very much 'caveat emptor'.

The first thing I do when I look at an advert is google the number, and personally I instantly dismiss anyone claiming to be a private seller when it is clearly not the case. I don't like liars, and if they are lying about that, what else are they lying about? :rolleyes:

I am trying to buy a horse. I continually call people who advertise as private and then go on to say they are selling it for a friend. They are clearly trying to distance themselves from their legal obligations if they are identified as "dealers". They get very arsey when you question them as to whether they are dealing. private people who sell a few horses a year, ARE dealers, but they don't like to think they are.

Having seen the horse they bought (to sell) from an old livery yard of mine, I wouldn't touch them with your extra long bargepole either I'm affraid :(

I know dealer bashing isn't allowed, so I wont go into the details here but buyer beware :(

Ditto to all the above! They have a very bad reputation round my way from a couple of horses they have sold to girls from nearby yards. :eek:

Shame as some of theirs look so nice :( but I wouldn't touch them with the longest bargepole in the world :D

Unless there was a law saying they couldn't, what's to say a dealer couldn't just claim a horse was owned and used by their daughter/son/spouse/granny to get around their legal obligations??? Seems to be it would be easy enough to use a new SIM card and therefore not have a trackable mobile number. That's why I personally have started avoiding ads which only offer a mobile number as the means of contact. I know I am probably missing out on 100s of really genuine horses but I just don't feel happy only having a mobile number as means of contact. Lots of people seem reluctant to give you their 'home' number and I notice lots call back (when they have to) with-holding their landline number. I wish they realised how this makes a buyer feel. :(

PS: Could we not keep referring to the dealer in this ad as HHO is bound to pull this post for defamatory comments (whether they're true or not :rolleyes:)

Are they selling a horse privately for a client perhaps? but yes that one has been for sale since at least the end of last year.

I noticed that a couple of their horses who had been for sale for AGES down in Kent appeared up here in Aberdeenshire with a dealer trying to sell them on... they are still for sale. They must have been for sale for a good 6 months now. Seems a real shame to pass them from pillar to post up and down the country!!

The legislation applies in these circumstances too! Sadly dealers can, and do continue to get away with being deceitful, which is a real shame as there are some brilliant dealers too. Personally I prefer to deal with a dealer who is secure in the fact that they are a dealer - one who has their reputation to live up to :)

Re: the mobiles, I don't have a landline! Lots of people don't now. And private sellers can be just as underhand as dealers anyway. Just got to keep your eyes open and try and avoid standing on a mine :rolleyes:

Standard dealer fare to move stock about. Makes sense really - if you cannot sell in one part of the country, say, as a random example, the south east of England, then it makes sense to swtich some stock with a dealer in the very far north of Scotland. You are then accessing different buyers who would not otherwise have travelled to those previous locations to try out these horses for sale.

Shame the seller sounds a bit dogdy...ad sounds just like my sort of horse...would like to see a few more photos though.

Sheesh - reading threads like this makes me shudder, it really does. Sooo difficult to know what you're dealing with (pardon the pun!). It almost gets to the point where I think, ignore what the ad says, always google the number, never buy without genuine (provable) history and only go by what you see of the horse. But even then, is that enough? :(

Although I would love to only buy from someone I know, or a I horse I already know, there aren't any of them around!
