Contracts at Livery Yards

Just wondering if any one else has been in this situation. I recently moved to a new yard well about 2 months ago. This yard offered part livery and as I have 2 horses and a demanding job this suited me perfectly. All seemed perfect as the yard seemed very well run and everyone friendly. I was given a contract to sign which seemed absolutley fine. It is based on BHS template. The part livery was either horse brought in or put out in morning. Four weeks after arriving I was told that this service does not exist anymore in fact she wanted us to join up with others to put horse in and out. Also price was to remain the same. Now as far as the contract is concerned the copy I have does not have her signature on it. I feel as if I have been duped into moving my horses to this yard and we all know how stressful moving is as YO must have known that changes were coming. Anyone been in this situation before and what should I do. Have also looked around and all yards nearby are full so I am kind of stuck.

err part livery is that the Yo or staff she has are to put your horses out and bring in, muck out pick feet out etc, just not the riding...so now she wants you to find someone to team up with to t/o and bring in? and price remains...umm she's so lost her marbles with this me thinks!
 
I know but what do i do. Am just trying to fit into new yard and now have to ask people I don't really know to bring my horses in and this happens will happen quite a lot due to work commitments which will make me feel poo as probably can't repay favour. I feel sick about it!
 
Part livery doesn't mean everything but the riding around here.

We have to go once a day on part livery and on my old yard you had to do your own mucking out. What constitutes part livery varies.

What your YO is proposing sounds like DIY to me unless they are calling it part because all your feed, hay and bedding are paid for in your rent. Either way, its a bit cheeky not to provide at least a morning or evening service, its bad that they have mis-lead you, and its stupid that the price stays the same when you get less services.

Unless there is a clause allowing for a change to the Ts and Cs, the contract is as written.

If you 'make any changes' (that you both agree to!), then it's a new agreement.

For my liveres we do the horse completely 5 days out of 7 and the owner does the weekend. If your YO is wanting you to make arrangements with the other liveries then is she paying them to do the work? if not then you might as well arrange it yourself and just pay her for DIY. Not right for her do do this just after you move and it seems like she has got your business under false pretence.
 
Has she acted on the contract to date? If so, I believe she has commited to the contract by the way she acts and via a verble contract even if she hasn't signed it! Did she sign the copy she has?

She may however be able to change the contract too but depending on the notice period she has stated in the contract.

have you a scanned copy to read? I have written a few of these yard contracts over the last 3 years and can take a poke. But if she has so far followed the contract to the terms and conditions then effectively you dont need the signatire as she has implied that she is bound by it by her actions. This is however a very odd/unfair situation!
How do the other liveries feel?
 
Hi everyone thanks for your replies. I called it part livery but basically the contract was that your horse would either be brought in or put out and this was part of the price. The contract is same as BHS contract with little changes such as the one above and the price structure which is now different. Its difficult to gauge other reactions as I don't want to be seemed to be bitching or causing problems but I have the feeling that a few others are concerned. Do you think I should approach her remembering that I really have nowhere to go. Who do you take these contracts to?

It is difficult to say as when I first moved there the horses were out 24/7 so the in or out part would not kick in until now really which is when she has changed the goal posts. I was thinking along lines of well if I know I have to work late a few nights then I could go up mornings put horses out and get all beds etc done and then get staff to bring horses in so I don't need to go up at night. The other problem is that horses have to be in before dark!!!! how the blazing do you manage that if you are working surely thats why you go to a yard that offers the bringing in service.
 
I'm on assisted DIY livery - our contract just states that X and Y are the overall managers, they are responsible for ensuring that yard standards are kept and that any rules are kept to - e.g. bringing in times.

I'm lucky in the sense that the assisted part of the livery is very flexible - I can theoritcally ask them to do everything one week and nothing the next!

As it is, we have a diary that any extra's are put into - it is one of the yard rules that all horses have to be in by a certain time and for safety sake in the winter, it is a 4pm deadline. As I'm at work, it is easier to ask the YM to bring him in than to rely on favours - particularly as my horse is a bit quirky and can be difficult, I know that my YM will handle him in a quiet, confident manner ... that is worth a £1 a a day in my book, knowing that he is in at a set time, in a routine he feels comfortable & that with someobody I know will handle him in an appropiate manner.

However, some of the liveries do 'buddy up' among themselves.

In your shoes - I would perhaps politely ask the Y/M why there is a change in the contract without drawing up another contract. Perhaps a yard meeting could be drawn, so that there is a united front?

If not, maybe a rota could be drawn up - maybe you can't bring in on a weekday, but could turn out on a weekend?
