Copyright photos, illegal use and theft.

I have unintentionally got into a 'fight' on facebook with some tweenagers over the use of a photo. It is in a group, and the horse is advertised for sale. The image very clearly displays a watermark, and of course the second I mention it i get jumped on by 12 year olds accusing me of 'bitching'. Am I correct in thinking this image cannot be used? I have emailled the photographer in question with a link to the photo.

petty, I know, but they really do my head in!
 
I have reported it to both, as the photographer is local. Some of my friends are professional photographers, and so I know how frustrating having images lifted can be.

I merely wanted to check I was correct in believing it is being used illegally.
 
Yep... Photographs are normally considered artistic works for intellectual property purposes and copyright automatically applies... Even without the copyright symbol or a watermark etc...

Obviously with some exceptions - ie photographing (to copy) something that already has its own copyright and isn't in a public area...

Had to chase down copies of my own product photographs quite a number of times... Grrrr...
 
Unfortunately it's ridiculously common, to the point where adults and teens alike think there is nothing wrong with it.

I've had too many photos stolen to count, repeatedly by one 'friend' who has now decorated her whole flipping website with them. Good enough to use all over her site advertising stud and horses but not enough to actually pay for... Not even a credit. Not worth taking legal action though, would cost too much to pursue.

I once asked a young teenager to remove a photo of mine she had stolen from the 'wall' thingy on facebook (friend of friend) and got told by numerous people i was bullying her and to stop being so petty.

Makes my blood boil to be honest.

Well done for reporting them, although not much will happen, they will probably just re-upload it in a few weeks.
