Court case - collecting pony update

as said above - don't go down the appeal route - money after bad

BUT make sure that she states that she cannot afford to pay all the costs and damages

instead let her offer to pay by installments

to do that she'll have to fill in an income v outgoings statement where stuff she needs to have to work to eran her wage count - so you can claim need to have car/computer/telephone/loans/mortgage, etc but not for holidays abroad

know someone that did this and they ended up being told to pay 40 per month.

think the person who shouldn't have won the case anyway may get their money in about 12 years !!!!!!!

it's the only 'justice' that was left as an appeal, like this case, wasn't worth the money as another dodgy judgement was just as likely

so just make the silly family and their nasty agression wait to get their pound of flesh
don't pay the money up front and don't take out a bank loan or similar to pay them
 
I wonder if there are any grounds for your friend to make some sort of counter claim? The woman who bought the pony clearly has no idea how to look after horses if she couldn't even be bothered to get a farrier! If your friend has had to pay out to have corrective work done, then she may be able to make a claim against the buyer for the cost of that? And wouldn't the fact that the pony was sore possibly contribute to any behavioural problems? Also, retaining the passport can't be legal, surely? She has no claims on the pony now and it's up to the court to enforce payment of any damages, not her. I'm probably talking out of my a*se, but it makes me so mad to hear about these morons who take on animals they simply can't care for or cope with. Like one of the other posters said, in my day you dealt with any problems or sold on to someone who could. Nowadays, its always got to be someones fault, never theirs - and the stupid judge in this case just reinforces that attitude.
