So thought id just let you all know the outcome of what happened with the crazy driver who decided was okay to drive like a maniac towards us last september if any of you read the thread.

so out second visit to court yesterday first time got adjurned.. and what a day the defendent decided to plead guilty to a much less crime where he wouldav only recieved a small fine and a slap on the wrists but as wed all turned up and thought this wouldnt teach him anything we decided to go ahead with the trial and go for the original offence which was a section 4a and involved him intentionally trying to cause harm or distress to us. much more serious offence. so we all had to give our account of events and how scary standing up in front of everyone and his lawyer was very very good and was trying extreamely hard to twist words and events. wed all given our evidence and the court had a lunch break where our prosecutor explained our chances were looking slim. and seriously made us doubt if we should have accepted his please of guilty for the lesser offence at least would have been something but was all too late at this point was all or nothing..

afternoon saw him giving his account fo events and with spectacular style he gave an oscar winning performance came across and such a good upstanding member of the community and at this point our prosecutor was very cleverly pointing out the fact he was acting for the benfit of the court and not showing his true colours.

the magistrates retired to make there decision. This was such a tense time and tbh we all thought we had lost and were all sat waiting for the smug look across the room.. 1.5 hours later we had a verdit and it was us who had smug looks on our faces as luckily the magistrates saw right through his performance and found him Guilty of all charges. huge sigh of relief as was all over and he would be punished for his actions. He recieved a £400 fine for the offence had to pay our court fees of £600 compensations of £70 and his own lawyers fees. the judge was very keen to totally ban the defendent however his lawyer was quick to respond and defend the fact he needed his licence to get to college and to place of work and so was let off with this. the defendent was not at all amused with the outcome and decided his best option was the vacate the building in a less than happy manner. followed by his father who had some choice words.

all in all a good result for us horseriders from what has been a very long drawn out experience and at some points stressfull but i firmly believe was all worth it. This may hopefully make him think next time about his actions and hopefully prevent any more incidents or worse of this kind.

My advice for anyone who is ever in a similiar situations is go to the the police they were very very very helpful in our case and couldnt have faulted any of their actions throughout the whole process.

That's a great result and well done for pushing forward for the more serious offence....that took guts :-) Pity they let him keep his licence though.
 
What an excellent result, well done you.

Have you reported this to the BHS Accident website. I was thinking of some tips if anyone had to go through what you did in court.

Hope this receives lots of publicity.
 
On the Pistonhead forum, he claims to have a £815 fine (in total) ... good to see it was more than that :).

His Dad comes across as a right arrogant so and so. Like father, like son I'd say :rolleyes:.

I am always cautious with these rulings where there are two completely oppposing views with 3 on one side and 1 on the other but a decision had to be made by the magistrate so that is what we must abide by

Any appeal will be a waste of time without fresh evidence
 
Well done for having the guts and tenacity to see this through. He was in the wrong and has been proven so (though I wonder if his sort ever learn...)

While I think it is a good idea that all riders (and cyclists) should be insured on the road, drivers don't have to carry ID so why should riders? And if anyone ever starts with you on the 'road tax' thing, then say you'd be more than happy to have a tax disc on your steed, then point out that as the price of a tax disc is actually vehicle excise duty, which is based on vehicle emissions and the cost of a tax disc to you would be exactly zero pounds and zero pence!
 
I wonder how he thinks the tax system could be applied to horses? Clip the licence no on? Or police cars equipped with automatic microchip recognition?
 
Glad to read this, I'm one of the posters who has been following on both forums.

The son sounds like a complete idiot, the reason he is not posting on the other forum is because he has been banned (and from several other forums too!). One delightful thread I read by him was when he hoovered his parrot up because he 'wanted to teach it a lesson'. It did survive.

Does this really sound like a courteous, responsible young man? :rolleyes:

Well done, especially for seeing it through. Hopefully the guy will take it as a check to future behaviour.

I've read both the thread on here and on PH forum... it sounds like the guy may not have been 100% straight with his father regarding the entire situation, but who knows. Even if it doesn't make them take a second look at their actions or behaviour, it may make other road users consider how they act.
 
I also followed this on pistonheads from the beginning, and the offender comes across as one of society's dregs - father doesn't work but has seemingly lots of cash (ahem!) and son flips burgers by day and shoves stuff up his nose by night. A real catch. I think he was banned, but not 100% sure.



I hope this case is a lesson to other drivers.
