Csan you get sued for horse on horse injuries?

I keep my horses at private livery with another two horses in separate fields. the owner has tonight taken her two through my paddocks and I think one of my horses kicked her two horses.
Can she sue for this????
 
This is what the 3rd party part of your insurance is for but is there a reason she went through your field tonight? Has she told you one of your horses kicked one of hers? Is one of her horses needing veterinary attention?
 
I doubt it. Well, she could sue but would lose is my guess. She's a horse person and therefore surely knows horses can kick. She chose to take her horses through a field containing a loose horse. IMO she accepted the risk. If she wants cover for her horses injuries in future, she needs to insure for vets fees.
 
No she usually does go through there but usually my horses aren't in that area. There is another altenative route for her to take but she chose not to. No she hasn't come to me but i am pretty sure the kick did connect - i know my horse did try to kick if she made contact or not i am not sure.
i thought nothing of it until i sat down and thought about if she'd go mad over it!

If there is an alternative route then yes she can sue but most unlikely to win as she chose to take this route and horses are unpredictable animals. :)
 
I'd keep your mouth shut and your head down OP if I were you!!!! :) Less said the better on here IMO!! as "walls" all too often have ears.

The YO knew presumably that your horses were likely to be in the area? and there was an alternative route she could have taken them??

She took the risk....... if hers got kicked, her problem methinks?
 
This is why you have 3rd party/public liability insurance but your insurance company will only pay if you were negligent. In this case your YO was negligent if any-one was.
 
and to sue someone is a civil matter not criminal so costs a bloomin fortune!! unless she's loaded and likes throwing her money and weight round i doubt you have anything to worry about
 
Its a sad truth that you could be sued for this (although probably unsuccessfully! ).

Why people can't accept that horses are horses, and yes- shock horror!- they DO kick each other.

Wouldn't worry tbh. Like you said, she chose to go that way.

I am just glad she didn't get kicked hopefully with this in mind she can use the other route tomorrow!
 
Our mare was at the receiving end of a kicking several years back and ended up with a fractured splint bone in five places. What shocked most people was that I didn't go mental, blame the owner of the other horse or threaten to sue etc. Horses will be horses, they have teeth, they kick - in my world if you don't like that then your horse needs to be kept either wrapped up in bubblewrap and at least 20 feet from any other horse or you accept that these things happen. The caveat here being if you know your horse is being kept with a known serial kicker or is a known kicker then either request to be moved or for the kicker to be moved. If the answer is no then move somewhere else.
 
Yes someone can sue for just about anything but when the consider solicitors fees, costs for bringing a case, court costs and the likelihood of being unsuccessful then it becomes increasingly unlikely. In your situation it would appear that they don't have a case. They could try but it could well cost them thousands.
 
What amazes and saddens me is the number of threads about whether you can be sued or you are being sued or can you sue on this website. I know things have got worse over the years but if this is a representative sample of whats going on we are all in trouble and might as well lock ourselves in a room and never come out. This morning alone theres the thread about A&E costs, this one and the dogs in their own homes, very sad :blue:.
 
I'm of the opinion that when they're in the field, they're effectively wild animals, specially when there are no humans about, so if I got injured by someone else's horse, or mine was kicked or bitten, I wouldn't even think about suing, or even speaking to the owner. You take the risk when you go into the field, or turn yours out in a herd. Likewise, if another horse trashed yours's rug, soak it up - it's not the owner's fault.

When mine finished her box rest earlier this summer I asked YO's permission to turn out in the isolation paddock for a few days and was told it was fine, but I wasn't to let her run about and cut the grass up. I had a word with her, but she just looked at me like I was stupid...
