Just a quick question out of interest alone..

How does the law on DP work re horses? For example if you were selling your horse from a schooling yard and you lied about the horse - and the new owner asked the yard - would it be within their rights to offer an opinion?


I haven't had anything like this happen but have wondered before how far word of mouth can be taken re horses.

if sombody is running a set up as a business then they are bound by the data protection act. so no legally they should not give out any details of the owner without the owners consent.

However if the seller was committing a fraud and the yard knew, not telling the buyer would make the yard and accessory to the offence.

This is interesting. I was involved in an RTA last week involving loose horses, and we knew which yard they came from, so I gave my insurance company the YO's details, assuming that he would be able to pass on the names of the owners of the horses involved, so that insurance company could confirm if they had their horses insured.

Was this the wrong thing to do? (PS sorry for hijacking post but it's got me worried now)

I always understood that Data Protection could be over ruled for "the prevention and detection of crime" therefore the YO could be required to provide the police with the details. Not sure if the insurance could insist though - perhaps someone with legal experience could answer that.
