Do I have any rights if buying from a dealer?

Hello all. My question is as above really, to eleborate a little. Spoosing I bought a horse from a dealer/trader. If the horse turns out to be a rearer having not been told about this, do I have any comeback at all? If the ad stated "Good to hack" and said horse sometimes refuses to go forwards and rears when pushed, is this a trading standards infringement? Obviously the dealer will say this has never happened when they had the horse, so havent gone there yet. Just wondered if anyone had any experience or advice?

Legally, yes, you would have some comeback. As always though it is likely to come down to the issue of proof so make sure that everything that has been stated is in writing!!!
 
Hi and thank you for replying. Have had him 5 days. Its not a massive problem, just a couple of short lived episodes of not wanting to go forward and popping up in front when pushed. I am not panicking just yet as he obviously needs to settle in, but my last horse turned into a raving psycho when i got him home rearing, spinning, bronking and I really dont want to repeat that!
 
He is possibly just trying it on. I'd phone the dealer and tell them you're having problems and see what they say, but I wouldn't send the horse back just yet if he's only had a few blips.

I'm sorry if you're experienced and I'm telling you to suck eggs, but is it anywhere the old horse did it and you are pre-empting it?

Otherwise yes you have far more rights from a dealer than private seller, if you have a copy of the original ad hold on tight to it, if not try and print one off if still online? Hope you have it in writing :)

Rather than leaving it til it becomes a major issue, maybe write to the seller and explain the situation (asking again if it has had a history of this - even rearing once) so that if it gets worse and you need to return the horse you have proof that it was happening from shortly after purchasing the horse and that the seller was advised of this.

Thanks for advice. Its good to know I can maybe have some comeback if things get bad. I dont want to rush and send him back as he seems a really sweet horse in every other way. Hes not hot and has been a dream in the stable and horsebox, field, everything. There is just this little tendancy to say no. I think I am wary about the same thing happening, so I do know what you mean about my last horse making me expect it to happen, but I am not a terribly nervous rider and I can cope with a sharp horse to some extent, but would rather have an easier time this time as I explained to the dealer at the time. I know they will say the never had any problem with him, as this is what the lady who sold my last horse said, but he was a loon and no way that happened overnight! i still have him by the way, so its not in my nature to just give up, but I have tried really hard to find a horse who wasnt a problem this time.

I think I will email her to tell her as you say, just in case it gets worse.
