Do you remember the little girl killed on a quad at Christmas?

yes, wasn't it another range rover that run into her and not her dads. i think it was a lady driving. Very sad
 
Yes I seem to remember she was on the quad on a narrow country lane in dubious light. Dad was either infront or behind her in his car and another driver came round the corner and smacked her.

Bloody shame, but unbelievably stupid. Feel sorry for the other driver too.

The comments about him having already suffered are true, however he was entirely responsible for the child's death. He not only bought her a quadbike, but actively encouraged her to ride it illegaly on the road. If he had killed his daughter while drunk driving would the sentiments about his having suffered be the same, I doubt it.

Quite. He also, if I remember correctly, took her home instead of to the hospital following the accident when earlier treatment could have saved her. Grossly negligent in more than one respect.
 
The tone of this thread is horrible. I'm sure most of us have done some things which on reflection were pretty stupid but thankfully have not had the tragic outcome which happened to this family. And no, I haven't put any kids on quad bikes on a road before anyone asks.

No jail sentence is ever going to punish him more than the loss of his daughter. And that is his life sentence. A moment of madness and his child gone for ever.

There's "pretty stupid" and then there is the degree of recklessness, or gross negligence, when there is a chance of death of serious harm, that is the required mens rea to convict someone of manslaughter...

No it isn't, but do you seriously think he should be let off because of that?? What about justice for HER, the poor girl who lost her life because of his actions. Taking a life/ or causing someone's death due to such recklessness/negligence is something the criminal justice system must hold people accountable for. You can't bend the rules or make exceptions - that would go against the whole rule of law!!

I don't think it's quite the same thing although just as stupid.
The world is densly populated with idiots. Argentina has a larger population than I believe is normal. You wouldn't believe the things I see on a daily basis. Idiocy is (sadly) not illegal, and I'm sure he's beating himself up for it on a daily basis. I'm sure the little girl's mother is too.
I'm undecided as to whether he actually needs to be prosecuted as well...
 
I think he does need prosecuting, because if then it makes one other parent think "Sh!t - I'm not doing that then" and stops another child dying under similar circumstances - then its worth it?

It was an incredibly reckless thing to do and his actions resulted in the death of a child. If it had been another relative with her - say an uncle, or a family friend - THEY would be prosecuted and the parents would be leading the charge pushing for it. Just because he's her dad and already suffering doesn't mean there isn't a case to answer for that poor little girl.

There was another case of a woman taking a child out halloweening on a pony in the dark - just as stupid and with an equally bad outcome sadly.

I'm not knocking the 95% of responsible parents out there, but surely if you have kids, you have a duty of care not to put them in harms way by being so stupid and actually think things through.

Quite frankly I thought the McCanns should have been charged over leaving the kids - if you want them - be prepared to give up your social life - not beggar off out with your pals leaving the kids alone and crying. Checking every 20 minutes doesn't cut it - it doesn't take 20 mins for them to die in a fire, fall out of bed, wander into the road - or be snatched.

Bottom line - you want kids - you are responsible in every way until they turn 18!

Indeed. The duty of care of parents is a massive issue - both in criminal AND civil terms. Yes, the parent may suffer as a result if they break it, and the child is injured/killed

They had visited friends. The father allowed the little girl and her brother to ride home on the country lanes with him following in a car. A vehicle coming the other way ran into her. They were quite powerful quad bikes as well, not suitable for small children. I think he should be prosecuted.It was a reckless thing to do. Children are precious and you should protect them from any sort of harm.
 
I agree with ISH_Mad. A jail sentence will prob be the end of him! Its sad that the thread is so critical. I dont see how punishing him will benefit anyone, its not justice for his daughter...........its not going to bring her back?! I dont think it will make other parents aware by punishing him as the incident itself would be enough to make them think? How tragic the whole thing is :-(
