As title asks really...my baby going on loan next week and his lovely new step mummy (cant bear the thought of calling her his mummy!) has asked about his passport - I keep that dont I?
I have a horse on loan and I have the passport. The owner photocopied every page of it and attached copy to the contract (both hers & my copy)
... supposed to stay with the horse I believe. What if loaner gets jabs done - or needs to prove on a competition entry that neddy has up-to-date jabs?
If they are going to compete or travel they will need the passport.I have one on loan and have her passport.If you are worried draw up a contract saying that >>>>is not the owner.You should have loan agreement which will cover you.I need the passport because we compete with her.
Indeed, stays with the horse. Also by law if the horse travels then the passport MUST travel with it. I'm also pretty sure its the law that the passport must be with the horse at all times (also technically when you are hacking out I recall from a previous thread on here) so the loaner should have it.
i had this recently when i put my horse out on loan - just take a copy of the passport then give it to them. should have your name and address on anyway.
I'd keep the passport if I were you. I had an iron tight loan contract and the loaner has made off with my horses passport and belongings. Take a copy of the passport and give them the copy.
there is another side to the arguement.... YO put horse on loan cut a long story short things got nasty and they went to get their horse back at 10pm on a winters night. YO had informed police of goings on and they attended. They wouldnt let YO take the horse off the loanees yard until they had the passport to prove it belong to them! Thankfully YO had kept horses passport so could show the police and horse was loaded and brought home.
I have loaned 2 horses out and either time have i allowed the passport to go with the horse. If vaccinations are being done i have sent directly to vet and they send directly back to me.
The Passport is not your property. It belongs to the issuing authority and must stay with the horse that they issued it too. If the horse is not with its owner, the carer must have it. That is the law.
A passport is not a proof of ownership, its legal purpose is to prevent certain drugs entering the human food chain. Some Vets will not treat a horse unless its passport is produced, which could be bad news for your horse if the passport can not be produced. If the horse is traveling off its yard it needs its passport.
You can get passports issued instantly at sales, and many vets will issue instant passports. So witholding the passport is not going to prevent any jiggery pokery by the loanee.
If you have reservations about the integrity of the loanee, don't worry about a piece of paper, worry about the welfare of the horse you are entrusting to them.
As has already been said in earlier posts the passport must accompany your horse where ever he goes (so it can be kept up to date, I guess), so you will need to pass it on to the loaner during the time they've got him on loan.
Presumably you have a good Loan Agreement already drawn up? That's going to be your best protection in the event of any later problems. If you haven't got one, GET ONE before your chap leaves your premises and make sure it is signed and witnessed properly by all parties. The BHS website have a good template for a loan agreement if you need one.
There are a few extra things you can do to help protect yourself whilst he's away;
Take a photocopy of his passport before you hand it over. Just in case it gets lost or there is any dispute at any time - you'll need its details.
Is he insured? Hopefully so. Make sure the insurance company know you are the legal owner and that he is only gone out on temporary loan. They should ask to know both parties name, address & the new stabling address. It just helps to clarify things in writing.
Is he microchipped or freezemarked? If not, have him chipped at the very least. Freezemarking would be even better. All my loaned out horses have been freezemarked as it's a definitive way to identify a specific animal incase of any dispute.
Mine is staying at present yard, and I pay for insurance (well my mum doesm and always have). Bum, I forgot about the freezemarking, I was going to get it done a while ago. I hope they can fit her in in the next 4 weeks before I leave.
Thanks Spyder. I have a BHS agreement which I have tweaked as she had bone spavin so can't do much (and if damage is caused by loaner to back legs - she pays!)
Passport belongs to the horse, not the owner, and is not proof of ownership! Make sure you have a loan agreement and a copy of the passport to keep yourself.

Passport has to stay with horse. It has to have all vaccinations etc recorded in it, so a photocopy is no use. Keep a copy for yourself, but the actual passport MUST stay with the horse.
I have my loan horses passport here with me, I did initially just have a copy of it but then needed it for her to go to stud so original was then sent up and it has stayed ever since (not that I'm with holding it - the owner didn't want it back!)
Although incidentally the passport doesn't have to go EVERYWHERE with the horse - only to competitions. So hacking out or travelling to a schooling session is fine to be without passport
funnily enough the passport thing came up at the yard today. i was told the passport had to be with you if you were travelling the horse, even to a lesson. Is that wrong then?
