I suspect the differnce of opinion here between the old owner and the new is in the interpretation of 'poor'.
The horse looks tip top in both of the pictures, if lacking some muscle in the first.
A poor horse imo is one that is underweight, has a dull coat, and looks as if it needs a good bucket of grub. A horse that is lacking in muscle and fitness is not (again imo) a horse in poor condition.

Starbucks: Maybe poor was the wrong word ..i possibly should have said he was a little lean for my liking. As I said in my original post I do not have my horses overweight. Yes Jannette was a little pissed off, but then again so was I. However I have explained my self to Jannette and we have sorted things out.
TGM: I am being very careful about putting weight on Joshua. Josh was sold to us due to lack of time, hence he was out of work, living out and wasnt really getting fed, as he didnt need to be. Since he came to us he has been started on a very basic feed alfa a/ a little alfa beet, carrots, vit min supplement. He gets a very small amount morning and night. He is slowly being brought into work, is already looking fitter. I never over feed my horses, I feed to replace calories used when working.
Amymay: that is exactly where the problem has occurred! And I have explained what I meant in my previous post. When we bought Josh as he had been out of work he didnt look quite as good as he does in those photos that Janette has posted.
Teabiscuit: Trust me Joshua will never be overweight in any shape or form.
As requested here are some photos of Joshua since we have had him. These were taken about 2 weeks ago. He will not be putting anymore weight on, he will continue on the feed that he is now, but obvioulsy his work load will continue to increase. If he starts to drop any weight then we will do something about it.
He is a 16hh registered Welsh Section D. Hes 8 but a little green for his age. He has been bought primarily for my slighty novicey mum and sister, which he is proving perfect for (not them riding in pictures). He is an absolute sweet heart and a proper character!
When my instructor rode him she has said that he will be giving my other mare a run for her money in the dressage arena (my other mare is v talented!!). Everyone at our yard has fallen in love with him!!
