Donkey, legal advise please

I brought a donkey a few months ago, I was promised he was gelded and even had a receipt ( I have looked closely and it's a photocopy) a few weeks ago I noticed a swelling and now he defiantly has two testicals. I did check him when I first saw him and there was defiantly nothing there. He was sold as a two and a half yr old and I now concerned he's not as old as his passport says. I have been in touch with the person who sold him to me and all that was said was he brought the donkey as gelded and he would try to find me a cheaper vet! I'm not really worried about cost of castration I am more worried that this person is up to something. Is there anything I can do? I am waiting for the vet to come out to check donkeys micro chip.

Whether I should report the seller, if other people would ask him to pay for the castration if I sent him the receipt. I asked him on more than 3 occasions if the donkey was already done. He promised me he was but it now turns out he brought the donkey from someone else and never had him done himself and I am sure he is the person who stapled the castration receipt photo copy into the pass port.

Honestly, I would be asking for something towards the op, he sold to you on false terms, although I think you may have a tough time getting anything from him unfortunately :(

But if it was me, I would be demanding he pays for the whole thing so that you get what you paid for!
 
I had exactly the same thing happen! My lad is just turned three and just dropped a pair to everyone's surprise. (mostly mine as my other ponies are mares) I got him from a friend who bought him as a gelding, she had checked, I checked yet still he sneaked under the radar.
Having asked on here it seems they are quite good at hiding them. Trouble is if they get passed from one place to another it's easy for it to be forgotten that they have yet to be gelded. I doubt you could prove who gave the misinformation in the first place to report anyone, but may be worth getting the chip checked for your peace of mind.
 
Thank you. That's what I thought but I didn't know if I had any legal rights to do this. Like I said its not really about the money it that I think he has scammed me. We love the donkey and would never ever dream of sending him back but don't want the man to get away with his scam.

If this wasn't an animal, if it was a physical product, you would 'win' no problem!

It's just the fact its a living animal makes it more difficult!

And even if the man before you didn't know, it doesn't matter, he sold an "incorrect product"
 
Tricky one. I'm not sure if I should continue trying to chase the guy or just say, you know what I've got a lovely cheeky donkey, and just get him done and put it down to a life experience!
 
I know what you means, it's a lot of hassle chasing that kind of thing up!

We purchased a pony two years ago, only to find out it was a rig *sigh*, we chased the man for two months before getting any money back!

Ha - another one, join the gang. Donkeys very kindly retract their balls when stressed. Therefore a canny salesman will tell you the donkey is gelded, poke the donkey to stress him and then when you look there are no balls so you pay the money and are effectively duped!!

How do I know? I bought a donkey from a local well known gypsy 14 years ago and got done in exactly this way!! It took me a month to work out why said donkey could think of nothing but sex and was braying all the time because everytime I ran over, the donkey got stressed and retracted his balls.

I think there is nothing to do but just suck on it and get the poor thing gelded. Donkeys are hard to geld so be careful, but he will be a much much happier person when he can think of something else other than sex.

Also, look on the Donkey Sanctuary website for really good leaflets and they also give fabulous information over the phone.

OP, one thing you must remember after your boy is gelded, donkey geldings are not like horse geldings. Some sixteen+ years ago, I took a donkey owners course given by the Donkey Sanctuary at their Derbyshire centre. After spending six hours covering all aspects of donkey ownership, I noticed one donk attempting to serve another (with all his tackle fully drawn). This went on for almost half an hour. I knew the Sanctuary didn't keep stallions and gelds those they have rescued. Several other people taking the course that day also noticed what was taking place out in the paddock. When the instructor saw us watching those two donkeys, he told us that their behaviour was something he forgot to mention earlier. Yes, donkey geldings will accommodate in season jennies, if the jennies encourage the geldings. Fast forward a couple of years when one of my ancient donks died, leaving my late gelding Dave. I purchased a two year old jenny to be his companion. When she came into season she would ask him if he wanted to "party" and Dave obliged...every time she came into season for as long as I had him (he passed away in August, 2012). The first time it happened I panicked thinking he was a rig. Not only was he not a rig, he had no jack (stallion) tendencies, at all. Frankly, if Poppy, my jenny, hadn't initiated the activity, Dave would never have behaved in such a manner. So, if you have any mares/jennies with your soon-to-be gelded donkey, as long as you know he has been done correctly, don't worry, it's natural for donkey geldings to be obliging partners to imploring females.

If you have a copy of the advert or any other information (e.g. gelding receipt in passport dated before you bought the donkey) proving he was sold as a gelding then yes, you should, in theory, be able to get the cost of gelding covered or return the donk for a full refund.

As you don't want to return the donkey I'd suggest asking for the fees to be covered and taking it from there if no joy - citizen's advice/trading standards will be able to advise.

Probably nothing you can do about him being younger than expected as you don't want to return him.

If your seller was also duped then it would be up to him to claim similarly from whoever sold to him and so on...
