Ebay returns - advice required please???

Have just recieved a set of competition boots I won from a private seller on ebay.
Unfortunately, they have got some damage that was not described (shame cos I really like them).
The lady has been very nice and is taking them back for a full refund but is NOT refunding what I paid for the P&P which was £10.
She is however willing to pay me £5 to send them back to her - which will just about cover it.
So in effect I will be out of pocket by £10.
Is this correct, do I have to lose out even though they were not as described, or should I be refunded everything I paid out ???
Does anyone know the ebay rules please ??
 
Partly depends on how you paid. Having said that a good seller will refund you the postage however you paid.

If you paid by PayPal and open a SNAD (significantly not as described) then you may have a better chance of getting your original postage back but you will have to return the boots at your own cost and you will need to make sure they go by a signed for method.
 
dont know how you stand on the postage but i bought an expensive item £350 when it arrived it was badly marked i complained to ebay credit card and solicitors but was told that it is a market place so it is buyer beware and that i had every opportunity to ask the questions before i bid. so from what i learnt the seller does not have to refund you unless you specificly asked are they damaged. with this in mind i doubt they would have to refund you postage as they are doing you a favour (?) by taking the item back. sorry this isnt what you (or i ) wanted to hear.
 
If you like them can you come to some agreement on a small refund to cover damage.
Otherwise I think you should get all your money back and I definately would not send them back until I did .Send back recorded delivery
 
Is the damage that bad? If they're competition boots then they'll get knocked around, brush marks etc the first time you use them. If you like them and bearing in mind that they will get marked the first time you use them then I'd go back to the seller and see if she'll give you a partial refund to compensate for them not being absolutely perfect to start with.
 
Did the seller have any Returns Policy. If not, they are not liable for refunding any Postage costs.
 
Ah we had one of these - one lady didn't like our leather. We don't generally refund postage on returns (this was exactly as described.. btw)

PayPal stepped in and we had to refund everything bar the return postage. So if you paid via PayPal you are covered (if the seller has funds!)

Seems to be a system on eBay that if you are a big seller with funds in your PayPal account they cover the buyer, but if you buy from a individual who took their money out of PayPal you are a bit screwed unless you get onto your credit card company.

FYI - we always refund and pay return postage when we make a whoopsie!
 
Its a hard one. Where the pictures of the boots? If so, could you see any damage at all? If you can possibly see even a tiny amount then the seller could say you could see it and that to buy them, you accepted that.

They should refund the postage TBH. Id demand it.

I paid by PAYPAL.
Yes there was a piccy of them but no damage seen as it's on the inside of the boot and the description said they were just tried on and never used as wrong size bought.
Yes, I asked before listing ended and seller wrote that they had no damage.
I offered to keep them but asked to have a partial refund of £10 (total amount for boots was £50.00) but the seller only wants to give me £5 - which I didnt really think was fair and I may aswell buy myself a brand new set.
As a say the lady seems very nice so I would obviously like to keep things amicable! (sp)
I have a think about it - cheers again.
 
You need to ask her if she if agrees that the boots are damaged and not as described, and she is willing to take them back, then she should issue you with a full and complete refund including postage. If they had never been worn, then she can take them back where she got them from and say they are damaged.

She is pulling a fast one here and you will be out of pocket. Or offer her £25 for them (if they are repairable) and everyone is happy.
