ebay saddle buyer reversed paypal money but wont return saddle :(

I am hoping it will all get sorted eventually, but I am having such a hard time at the moment with ebay.

I sold 2 of my old saddles recently. One buyer bid 6 times, and then never paid, simply saying they changed their minds, so I had to go through all the rigmarole of trying to claim back the ebay charges, which are quite high when you are selling relatively high price items like saddles!

But the the other saddle is the one I feel sick over. It was a lovely barnsby Jump saddle, and there was nothing wrong with it. They paid me, and I wrapped it up very securely and completely over the top, using about £10 worth of bubble wrap, and loads of scrunched up newspaper in the box, to fill the gaps. It said in my terms of sale that I would not accept returns if the saddle didn’t fit, (most people selling saddles on ebay will have these terms). Anyway I received an email a couple of weeks later saying it had a broken tree !?! I told the buyer I was astonished, but I would of course give her a full refund on safe return of the saddle, and with a letter from her saddler confirming it had a broken tree. (I thought my reply was fine, don't you think?)

I heard nothing more from the woman, until all the payment I received for my saddle was removed from my account, and 3 weeks later my saddle has not been returned and all my correspondence to the woman is being ignored. Ebay and Paypal are involved, but I feel helpless and not in control at all, and they seem to be on the side of the buyer. I don't particularly care about the money now, but I want my saddle back in one piece, which I strongly suspect it won’t be, if I ever do get it back. If it has been maliciously sabotaged, how would I prove this?

To me, it feels like my saddle has been stolen, and it's outrageous they can reverse payments so easily and not have to return the items :(

Has this happened to anyone else? Any advice

I am having problems myself, with a buyers bidding and having no intention to buy on my latest clearout. Extra time and trouble to go through the proceedure etc as you say, I know its not ebay, but people and it seems to be getting worse:(

It doesnt seem a fair system, weighted towards the buyer like that though does it?
 
That's an awful situation to be in. Unfortunately hindsight is a wonderful thing and you could have photographed it and had your saddler check it on the day of postage as I did to help have some comeback in this situation. However what's done it done. Definately set up a dispute with paypal and ebay and send them any evidence you have. Have you had a saddler out to check the saddle recently who could help say it wasn't damaged, even if it was a few months before? I would also argue that she had the saddle a reasonable amount of time before lodging a complaint suggesting that the saddle could have been damaged between her receiving it and the complaint. If she tries to say it was damaged in the post then why didn't she complain before? put all this to ebay and keep argueing your side. Good luck.
 
Ebay can be a nightmare I am being totally put off using it due to recent experiences, mostly from selling a couple of saddles and using an online tack shop that was fradulently hacked into via Paypal.

Kepe on at Ebay and Paypal and as soon as you can escalate the issue. I sold one saddle, to the address listed on ebay for the buyer only for them to try and get money knocked off as it wasn't the correct address, even though the postcode and farm name were the same... just cheeky sods trying to get a bargain.

I would use freeads and preloved now for selling anything of any worth, ebay fees are too high and buyers are a pain!
 
It is infuriating, try going to the guys who sort these things out all the time: here. They can be a bit scary but they know their stuff and will help you to get sorted out.
 
Firstly don't panic

They have filed a claim with eBay / PayPal - and the first reaction is to take the money out of your account in case you disappear faster than a Nigerian rat up the proverbial drainpipe

Secondly under eBay rules if you have send recorded then you are covered by seller protection

You just need to dispute the case saying that saddle was fine and believe they have either had an accident with the saddle or are falsely claiming (if no third party confirmation that the tree is broken)
 
That is disgusting......and another reason why I wont use e-bay anymore.

I sold a saddle last year, woman paid for it, I sent it off & then said that she hadnt received it & re-called the money back (I know she received it as my other half delivered it to her on the way to one of his jobs once!)

It turned into a big mess & in the end me & other half turned up at her yard & took the saddle back ourselves as e-bay & paypal washed there hands of it.

Will never use them again!
I hope you get it sorted, you may end up doing what we did!
 
Sorry to hear this. i have just learnt the hard way to put on NO RETURNS having had someone return stuff claiming it was damaged and its not!!Now I understand the comments of "I am not a business, selling personal stuff, look at the photos"

olop - if you'd got a piece of paper with her signature on it then PayPal would have supported you. They are in to proof, rather than verbal, so you need to cover your behind and belt and braces everything.
 
I too am not selling things like saddles over ebay anymore.

I sold a saddle that was picked up.

Then was told saddle was in worse condition than picture indicated, er item was picked up!!!

They filed against me, so I refunded item and I have never had it returned, they say it was sent in the post.

What I should of done is not refunded until I received the item but as the item was a pick up item and they couldnt deliver it back to me I agreed that I would refund the money and they send it to me. Last time I trust anyone or ebay as I have had no support from them whatever.
 
Oh dear Alice, what a blloomin mess. I really hope that you get it sorted and your saddle back. Im sure you would have know if the tree was broken, do they think you were born yesterday !. I was thinking of putting one of my CB dressage saddles on ebay, but decided to use Pre Loved instead. Dont mind using ebay for smaller items. Let us know how it goes.
 
I have loads of photos of it that I took for the ebay advert, and it has been examined externally, but not opened up recently (It was last reflocked about 2 years ago). My own saddler saw the saddle at the begnning of January, as she was on our yard, seeing another horse. I asked her if she wanted sell it for me, and she examined it thoroughly, and said she would, but I would probably get more money if I sold it privately, which is why I decided to do that.

What is really upsetting me is that these people haven't returned the saddle - I never disputed the buyers claim, and even though it's highly unlikely there was a broken tree, I can't prove it wasn't broken as we never opened up the saddle before I sold it.

I know kay! There was nothing wrong with it. If it fitted the new chunky boy, I'd be using it, but it's a narrow fitting, and Z is wide!

If she is just trying it on she would be really evil if she broke the tree purposly if sh had to send it back to get her cash.
 
Any saddler can tell if the tree is broken or there is a suspicion of a broken tree without having to open it up. We flex the tree under tension lengthways and across the tree and we can tell if there is something wrong. In the old days of saddles made with pre strained Flax webs they often (almost always infact!) went slack across the seat giving the impression of a broken tree (ridges in the seat) but it is unlikely this would happen to your saddle as it sounds like a relatively new one?
Your saddler would have checked the tree for soundness when they examined it, it's second nature when we check over a saddle. Maybe ask the saddler for a statement of fact if they are willing to help you?

Yes, we did check the saddle in this manner before I sold it. My saddler saw the saddle and she would have taken it, but I thought I'd be able to get more money by selling it privately. That's why I'm 99% sure there was nothing wrong with it when it left me. The way it has not been returned to me, suggests there's definitely foul play!

I'm currently waiting for ebay to give me an update..... It's the last time I sell anything on ebay!

sorry to hear this and sorry to tell you my son had a similar problem with a phone. paypal took the money back £300 the buyer had said item was not working.

My son chased and chased it but he never got either back

I too won't sell items on there unless I can afford to risk losing the money. however have had lots of easy transactions over the years
 
Huh.. last time I contacted PayPal/eBay because I received something incorrect from an eBay seller and tried to open a claim, PP told me they weren't interested and closed the case immediately - telling me to liaise with the seller myself to sort the problem out. They said they only dealt with 'non delivery' of goods and NOT disputes over condition or mis-description. Bloody useless.

Fear not though! Your saddle payment is invariably on hold by PP. It doesn't mean the buyer has been given her money back.

If PP are willing to get involved, they will ask the buyer to return the saddle to you within 'x' number of days and then provide THEM [PayPal] with proof of delivery back to you.

As proof of posting alone isn't sufficient for PP, your buyer will have to use an expensive 'signed for' service to return the saddle to you. If the buyer doesn't provide PP with proof of delivery within the set time period, the case will be closed in your favour.

Worse case scenario is if the seller returns a broken saddle to you and PP refunds them their payment. Who's to say it arrived with a broken tree at their end??? Maybe it just didn't fit and they wanted a way to wiggle out of the sale. Huh... people! :(:mad:
 
Just a thought - where abouts did you send it to. If it'ds not local to you perhaps there is someone on here who would be kind enough to go and collect it for you. ;)
 
As above.

This is becoming quite a well used scam now. Buy something, complain in the hopes the seller knocks off some cash or tells you to keep the 'broken' item or snatch the cash back from Paypal and get goods for free.

Can any of us help locate your saddle and possibly reunite you with it?
 
I've had problems too. I'm trying to sell a saddle for a friend. I've had one person buy it on a 'best offer' basis only to then claim the day after that she had only just measured her horse and it won't fit. Yeah right, of course you would buy a saddle to have it posted without knowing what size your horse needs.

Another person kept sending me emails offering well below its value I would imagine in an attempt to bully me into accepting it. In the end I told them to stop sending me messages.

I also sold a rug recently and had one person bid then email me asking to retract it. No reason given. You just know its not worth forcing the transaction as they will either not pay or give bad feedback.
