Ending a loan agreement...

Hi guys, i'm in a bit of a situation at the mo and need some advice.

I've been loaning a pony over the summer but am going back to uni in September. In our loan agreement (a modified version of the BHS one, witnessed + signed by the owners husband) it says I have to give 30 days notice before I give the pony back, which is fine...but, it ALSO says in the contract that I am responsible for his shoeing, and also the name of the yard he is kept at is different - both of these have been discussed and agreed but not changed in the contract.

I've unexpectedly had my hours cut down at work, and finish next week anyway, so I told the owner I could nly have him til the end of August (2 weeks away) because of my hours I can't afford it, because i'm going back to uni anyway. She got really annoyed at me and told me I had to pay livery til the 30 days notice is up.

Now I will pay if I have to but I can't afford another £100 now i'm hardly working, and other stipulations in the contract aren't being followed so...is there anything I can do to not have to pay for the 30 days?

Don't want to sound like a tightwad or like i'm trying to get out of the agreement, I really like this pony but my pay next month is going to be pittance and i've got to get myself sorted for uni. She's given me grace on the other two changes to the contract so why not this one?

Having loaned out my horses and ponies before, I know totally where the owner is coming from. As an owner, I do my best to help out where I can, but you signed a contract agreeing to give 30 days notice, and it is not fair on the owner to have to rush out and find somewhere or someone else to take the pony at short notice because of your situation. I have had to do this numerous times because loanees have not bothered abiding by that part of the contract. It is funny how loanees want everything to suit their situation and themselves, without giving any regards to the situation the owner might be in. I am sorry that is not very sympathetic, but at the end of the day you should be responsible for this pony. What if it had thrown up an unexpected vets bill whilst in your care - would you have just handed it back then too?
 
I'm afraid I have to agree with zoeshiloh. Surely you knew you were going to uni in September so why didn't you give notice to terminate at the appropriate time?

Agree with owner, you should pay the livery for the 30 days notice..poor owners probably got to arrange stabling/finances and everything else for his return..2 weeks is short notice to get all of that done!
 
Yeah I can obviously see where you're all coming from and I agree, but I didn't know i'd have to give him up now - I thought i'd have him for another month at least. It's just my hours at work have been cut down, I have to buy stuff ready for uni but my last wage packet is going to go on livery.

He is stabled at the same yard they had him at and they have their other two horses there so they don't need to worry about moving him or any of that.

I was just thinking it seems like the owner is picking and choosing which conditions she doesn't mind sticking to.

I think it's great that the owner has been happy to compromise on some things - however livery is expensive.

To be honest, I'm not sure why people bother with loan contracts - as I've never heard of one being stuck too.....

perhaps it's just to help them from a financial point of view as they're going to be paying 300pm for three horses once the notice is served

Really sorry but if you agree and sign a contract you should really stick to it. No matter if your finanical situtation changes..........

Sorry otherwise whats the point of signing contract.........

legally you can get dump with bill........... seen if owner can be flexiable, BUT be warned she very entittled not to be.......
 
Sorry but if you take on the responsibility of an animal, you have to pay the bills. If your last pay packet goes on livery rather than stuf for university, that's life and the cost of caring for an animal. You agreed to 30 days notice and its not unreasonable of the owner to ask you to stick to that.
 
i would be really pi$$ed off if i put a horse on loan with a 30 day termination clause and you wanted to get away with paying for 2 weeks.

you should be grateful she was flexible on the other 2 points, not throwing it back in her face because she won't let you off the hook.

you took responsibility when you took the horse on, so be responsible.
 
Sorry totally agree with all the other comments - you agreed to the 30 day notice and you are now back tracking.

Its things like this that stops many straight people getting the oportunity to loan a horse. If i was the owner I would feel totally used and why did you not have an end date to the contract anyway if you were always giving the animal back after you had had a lovely summer using it?
