An interesting case as the pony in the middle of the dispute was advertised in 2014 looking like a seriously decent sj pony, hardly a raving lunatic in the videos, he had a very good BE record and looks as if he justified the £18k price tag but was unlikely to be suited to a nervous child, probably a case of the parents overhorsing the child then expecting their money back when it proved to be too much for them, the seller was probably badly advised as these cases usually benefit the lawyers more than anyone, hopefully the pony ended up in a good suitable home.

If the pony was a nutcase it still managed to be placed at scope in 2013 with Elise Walton, I cannot believe they won the case with that evidence, there may be more to it but to go to court when the child is obviously out competing seems to be in conflict to the claims being made, I guess they sold him on in 2013/14 so should have recouped some of the purchase price and I would have thought made going to court pointless, it just goes to show anyone who sells a horse or pony is at risk of being sued.

It's actually really weird because the pony and child it was bought for were out competing in 2013.

It makes you wonder why anybody would risk £140,000 of legal costs for an £18k pony! £18,000 is a lot, but surely you'd stop before it reached that much?

I think the buyer is at fault (as has been found) but who has been leading this woman to believe she had a justifiable case and a chance of winning - I'd be none too happy with whoever that is!

Agree on both points. Who on earth spends £18K on horse/pony for a "nervous" rider - a rocking horse might have been a better investment. I actually feel sorry for the child because it sounds like pushy parents hoping to make up for lack of a pair by buying a ready made winner.

how bizarre, so they kept him for a couple of years, nearly qualified for hoys as above so obviously doing ok by then, wonder what they sold him for? Or whether they passed him onto the owners of the youtube vid to sell? Who has a BS membership to do look ups on results :p

plenty of video of him eventing, including the big drop at wilton!

Seeing as the claimant bought the pony in 2011 and this video was in 2014 (with a different rider) I think it has. Though that raises questions about why you would sell a pony if you were in court trying to get the vendor to take it back and give you a refund..... If they sold it, I suppose someone else could just be riding it.

that one was certainly a for sale video, if not sold to them previous and 'teamhewitt' were just selling it for the owner then I dont see why it wouldnt have sold but no proof without looking up record a bit more.

I meant I'm surprised they were allowed to sell the pony if the court could rule that it should go back to the vendor, but I suppose 'teamhewitt' could simply be competing him for them and building up his record should they be in a position to sell him after the court case.

Yes I did get what you meant, thanks photo-jo. seems they did have a break after buying him but hard to say that's not a good/18k pony with the record.

Not really, he was at Wales and West (presumably the show at which she tried him) at the beginning of May and was out competing on 16th of June so only 6 weeks. She didn't seem to compete particularly regularly though - about once every 6 weeks/ 2 months.
