Re my previous post today about renting land behind a new property Im hoping to buy. I was hoping to purchase a parcel of land but apparently the owner is only prepared to rent it out. I asked if it was poss for long term rental and apparently its possible to do this as farm business tenancy....can anyone explain this and the possible implications?
 
Sounds to me like it would have to be used for agricultural purposes. I'm afraid horses arn't classed as agricultural.
 
FBTs can take all sorts of forms - suggest you contact a local land agent who will tell you if it is possible or not. They shouldn't charge you too much just for a bit of advice!
 
I may be miss understanding this situation but are you sure that what he's telling you might be that. He can't sell you the land because he doesn't own it he may only be a tennent farmer. Which means he could rent you some land for the period of his tennancy only.
 
The business of whether horses are "agricultural" or "recreational" is an interesting one, that a lot of people down here in the New Forest are taking a lot of interest in at the moment. Under the current planning rules here in the Forest, if horses are kept at a density greater than 1 horse/3/4 acre (0.3ha) then it is considered a change of use from ag to rec horse keeping. There is currently a proposal to change the rules from the above to one horse/2.47 acres (1 hectare). As you can imagine it has not gone down well at all.

the best suggestion I could offer would be to get hold of a copy of your local planning authority's planning rules, which will clarify the situation for you. Or phone them up and ask at what grazing density do they consider it counts as recreational horse keeping rather than agricultural use. At which point you would have to apply for change of use of the land.
 
Our local council rent land out on grazing tenancies to horse owners and FBT's for use by sheep and cattle. Think you may have more security with an FBT or a longer rental period. Can you ask him for a copy of the FBT to read before you commit to anything?
