Hello,

I dont know whether anyone on here can help me but at my yard last night there was a terrible accident and the lady involved is still in hospital.

On my yard the farmer owns some fields that we can use to hack around, he does however lease the fields and another farmer grows crops etc on them. Yesterday afternoon the farmer that leases the land showed no considertion to two ladies hacking (who were both in hi-vis). Their horses who are completley safe and virtually bomb proof took off......the farmer kept the tractor going towards them, which caused them to dump the two ladies and take off again. The said farmer then just kept the tractor going past the two ladies whilst one was laying unconscious.

This morning the farmer who owns the land and the lady who is not in hospital went to see the lease farmer and talk about it, to which he literrally laughed in their faces!

We have called the police who have said nothing can be done.
The farmer who owns the land says there is a contract so he cannot do anything.

Is there anything else we can do?

Thanks for any help, it was so distressing last night at the yard, i dont understand how you can keep going past when you see someone lying unconscious. what sort of world are we living in.

I can't believe nothing can be done - I would contact the BHS legal helpline for advice, then perhaps the police again with a more formal approach!

Horrible story! Why can't nothing be done? What did the police say exactly? Surely even if it's not a criminal matter, they can bring civil charges against the driver? Ditto BHS, hope they can help!

I had a similar problem on the roads, friend fell off and tractor driver drove off, then horses bolted (with me still on board), eventually stopped in front of another tractor (they were bringing in the silage so they were all over the roads), tried to get off and catch the other horse and tractor driver drove off causing another accident!

It sounds like the culprits might be "contractors" working for the farmer???

Often these employees come from Eastern Europe where they just don't see people riding out on the roads like we do here, plus unfortunately they frequently have a blatent disregard for horses anyway, as horses are a meat crop in their country and not used for pleasure purposes.

The farmer's reaction is shocking to say the least: unfortunately there are some farmers who think its funny to spook horses like this, often they're driving far too fast for narrow lanes and their vehicles often rattle and make a helluva noise. There's a farmer near us who'se wife drives like a blimmin lunatic - and there's no excuse coz apparently she used to ride :( In mitigation of farmers generally, I know that frequently they are very pressured for time and to see people apparently swanning around on horses whilst they're having to work darned hard getting the harvest in, or whatever, must be galling to them, but still there's no excuse for this sort of behaviour whatever the provokation.

Surely there is a case for driving without due care here. I'm not surprised the police will do FA - a similar thing happened to me while I was riding and someone drove into the back of my horse, and because I wasn't injured as such, they did sweet FA. But I think you need to take this further and perhaps contact your MP or someone like that.
