I lease a 4-acre field that has a public footpath running across it with a stile at each side. About a week after I moved in, the estate agent who handled the lease happened to be passing so he stopped to say hi and asked how it was going. He then asked me whether I had any insurance yet (this hadn't been mentioned at all during my application). I can see where he's coming from, the horses are covered for TP liability but as my OH pointed out, if someone were to trip on a stile and injure themselves, I suppose they could claim from me.

I'm going to ring around today for some quotes, but I just wondered if anyone else bothers?

Because you only lease the field check with the owner - he should have public liability insurance already in place to cover both you as the tennant and the footpath users.

However, it may be a condition of his insurance that you have a policy in place to cover any incidents involving your animals i.e. they kick or injury a footpath user. You need to confirm with your insurers that the horses are kept in a field with public access - this can vary your policy terms and premium.

check the terms of your lease - you may find there is a clause in it regarding liability insurance.

You must ensure that you have adequate liability insurance for any injury or damage your animals cause, that bit is obviously your responsibility.

The land owner should have insurance for public liability which will cover the footpath users BUT you must check this. You may find it difficult to obtain this as a stand alone cover as you don't own the land unless it is written into the terms of your lease that the landowner has passed this responsibility to you.

If in doubt contact a local solicitor for informal advice.
