Are they BE legal? I never thought they were but have seen a huge amount of riders going XC in them recently!

Nooo, I don't think they are allowed! Definitely not at BE90 level anyway ;)

BE rules taken from there website -

CROSS COUNTRY PHASE
7.15.1 All Classes
• Protective headwear with cover
• sweater or shirt (long sleeves are strongly recommended)
• Body protector
• Plain black boots or topped boots or full grain smooth black leather gaiters
with matching boots, with white, buff or fawn breeches ORbrown boots or
brown leather gaiters with matching boots, with buff or brown breeches.
in BE80, BE90, BE100, BE100u18 and onu18 sections only, Competitors
under the age of 16 may wear jodhpurs with jodhpur boots ORplain black or
brown half chaps with matching boots.

and the part about hats

Hats. a ‘riding hat’, designed to provide protection, must be worn at all times
by anyone, whether or not a Competitor, riding anywhere at a BE Event. top
hats and uniform hats are permitted as an exception to this rule only for
dressage and mounted prize-givings (where appropriate) in intermediate
Championships and advanced classes and in certain FEi classes.
if a hat comes off during a dressage test, it must be replaced immediately; the
Competitor may dismount or the hat may be handed to them. the test will be
restarted at the beginning of the movement during which it came off. there
will be no penalty for error of course but if the hat is not replaced the
Competitor will be eliminated.
Protective headwear, as listed below, must be worn by Competitors at all
times when mounted in BE80, BE90, BE100 and BE100 Plus classes. When
jumping, including warming up, all Competitors must wear ‘Protective
headwear’ i.e. a hat which meets one of the following standards.
British–all Pas 015, BsEn1384 Provided they are
European–En1384 }Bsi kitemarked or sEi
American–all sEi astM 95, astM F1163 2004and snELL E2001
Australian & New Zealand– all as/nZs 3838 2003.
‘Protective headwear’ must show a visible current BE ‘hat tag’. harnesses
must be correctly fastened.
Competitors are strongly recommended to check their hats regularly and to
replace them if damaged, or following a fall.

As far as they are the correct standard I can't see the issue with a fixed peak if they are safe to fall off in one disipline they must be in the others.

There is no such thing as a 'fixed peak' any more. For hats that incorporate a peak to have been approved to any of the current standards the peak must be collapsable or designed to detach without shattering on impact.

That's brilliant then as my KEP is so much more comfortable than my skull cap..... Always hoped I'd be able to wear it xc one day :)

Most modern helmets have a peak that will break off very easily :) In Aus, everyone wears helmets with a peak, over the skull cap and cover.

This is odd, i rarely wear anything with a peak after i came very close to a broken nose from one years ago.
are peaks these days so shatter proof they would shatter before my nose would...

Correct. Has been this way for a few years now. I go BE in my 'fixed peak' every week. Its tagged by BE and BRC all over!

I ride in one of these.

I use it for Dressage, SJ, XC and have never had a problem with it. The peak is quite flexible and I have no trouble believing that it would shatter on impact should the occasion ever arise (thankfully I am yet to test that feature out - touch wood). I have one for schooling and another for competitions (also as a spare just in case). My boss uses his - same brand, same model - when riding 2*.

Skull caps are not that common in Aus, the vast majority of riders use helmets very similar to the one I use.
